de nying tho affirmative allegations contained in Davisons notice he con tinues Further answering herein I allege that It would not be an honest count to count any votes that were not cast either for you or for me That this election must be determined all other elections have always been determined by the votes that are actually cast and not by those who failed or refused to vote It is quite true thatyou received a very small vote in 1898 as compared with the vote In 1890 For in 1856 yon received in Anderson county 1157 votes whereas in 1898 you received in thatcounty only 872 In Boyle coun ty in 189C you received 1093 votes but you only received 1209 votes in 1898 In Garrard county 1890 you received 1001 votes whereas in 1898 you only received 1220 votes In Jessamine county 1S9G you which was com posed of delegates Jrom the other ten counties only and solicited a nomina tion at their hands TillS convention was held and you were nominated long after the passage of tho Act of March llth 1898 The presiding offl cerof that convention and tho Secretary issued to you certificates certify ing that you were the regular Republican nominee for Congress in the Eighth Congressional district You accepted thesQ certificates and caused them to be delivered to the Clerks of the ther ten counties only And you caused your name to ba printed upon the ballots in these ten counties only You sent no such certificates to the Clerk of Jackson county and you made no effort to jiave your mime placed upon t1ltbaIlptSbf that county You seem not to tiavb discovered that the Eighth district majority of the votes as it was when you received a minority of the votes And if the district contained a popula tion so small that a majority of the legal voters connot select a Rotresen tative in contained in the Eighth district of Kentucky Indeed I aver there are msny Congressional districts in different States with a larger territory and a much larger population than are found in the Eleventh district of Kentucky and that there aro many other Congressional districts in those same States having a much smaller popula hon and n much smaller territory than are found in the Eighth district of Kentucky I maintain that all Con gressional districts in all the States are and have always been the crea lures of the State Legislature and that this is the only tribunal known to tile Constitution and laws which has the authority to make or alter tho bounda nes of Congressional districts I insist that the greater power conferred upon the Legislature to establish Con gressional districts carries with it the lesser power to altar the boundaries of suph districts And it is the duty of the Legislatures of all tho States un der Section 4 of Article 1 of the Con stitution of tire United States to change the boundaries of such districts whenever in the judgment of the Legislature such change should be made I insist and avar that tho Legislature of most if not all of the States have re peatedly exercised this power and have repeatedly changed the boundaries of Congressional districts and such Acts have always been regarded as conclusive upon Congress I aver that nopre cedont in tile history of this govern ment can be found for such a contest as this and that no member of Congress otherwise confessedly fairly elected has ever been deprived of his seat on account of a
