Lincoln with perhaps less money in the bank but more in their pockets The able Jurist Judge Morrow is on the bench and gave the grand jury an able exposition of the law I am proud to know that I read law under the instructions fa Judge as able and famous for his learning I believe all the good law I know I learned from Judge Mor row and the bad I have imbibed from such men as Blackstone Goke and Lyttletou 1 dont know of but one point upon which the learned Judge and I differ and that is upon this1 point I assume that a grand jury isa mere accus ing jury to enquire whether or not 4 ere be sufficient evidence orV ijof against the accused to call upon him to answer before a ury before the Judgi Often trialI alf the witnesscs are before the rand jury and not more than l lfl- thetestimony from them and even before the trial jury it sometimes takes the shrewdest Commonwealths Attorney to extort the truth from the reluctant lips ofa dishonest witness If the grand iury have sufficient evidence before them to justify an indictment the defendant should be called upon to answer before the Judge and trial jury But if the grand jury do not believe but not beyond a reasocable doubt there is sufficient evidence to warrant a Conviction they should not indict But the reasonable doubt that ac quits so many guilty men prevails alone before the petit jury But several other Circuit Judges
