made a will on the 26th day of October last and dicdNov 4th The will is offered for probate to which the contestants object On the ac count of the intense interest man ifested in this ease the Court de sires to hand down a written opin iou setting forth reasons for the conclusia7isreached The statutory requirements touching the execution of the will are admitted but the instrument is attacked on the ground f testaI inItpose of his property This being the principal ground reliedupon by the contestants the JestimonyI adduced by both sides mainly to the elucidation of that question The testimony upon this subject conflicting in character Under Section 4825 of the Kentucky Statutes every person ot sound mind and over twentyone years of age may make a will The proof shows that the testator was about eightynine years ofage and no doubt mental decay had be gun to till on the test tor Being of legal age was he ot sound mind In the case of Wilson vs Hays Exr Southwestern Reporter page 773 Soundness fI mind in making a will is for the testator to have such mental capacity as to enable hioi to know the objects of his bounty the char acter and value of his estate and dispose of it according to a fixed purpose of his own The same principal is enunciated in the case of Tudor vs Tudor 7th Kentucky Reports page 382 which is an ac tion appealed from the Madison circuit court Under the law above laid down the following questions present themselves in this case Did the testator herein know to whom he desired to give his property Did he know the objects ot his bounty Did lie realize the character and vahie of his estate Did he disposes of his property according to his own fixed purpose tiThe Counsel for complainants contend that because the testator said in response to a question of the draftsman of the willas to what aispositiou he desired to make of his real estate that he wanted to give it to Miriam Hays during her life and at her kl th to her daughter without giving the name of the second benefiriary when the testimony showed that the conte tee Mrs Hayes has several daughters Another reason for breaking the will is that the testa tor did not recognize one of his neighbois who was amongthe call ersat time testators home during his sickness immediately before his death The third reason as signed by counsel is that mental dissolution had set inland although 89 years of age the testator talked and acted like a child As soon as the draftsman called attention of the testator to his omission e said that he didn t herwould will it to whom he pleased of acres owned by the testator Then he was correct in tlia fractional in terest owned by him and the num ber of acres in the entire boundary He talked of the value ofa certain horse giving his name and offered to sell him for a certain price at the time the will was ieing written and there is no proof in the case pricehfhe third ndand ast question isdid he give his property accord nag to his fixed Purpose There is no evidence to show that the testator ever desired or intended to give his real estate to any other person There is no evidence of any undue influence neither was any improp er means used in obtaining the ex ecution of the will The devisee was a putative neice to whom he had a right to bequeath his land if he so desired Theyoung man to whom he gave part of his personal property was his nephew and a son of the contestant W B Sayers The complainants also contend that because the testator left part of his estate such as hay corn and hogs undevised the will should be this case that the testator knew of his omission or failure to devise part of his personal property and gave as his reason for so doing that he might get well and if he did he wouldneed the povender for his stock and the meat for himself The testator knew that he had property to devise for had he not known it he would not have sent for a lawyer to writelliwilL The old man was growing feeble and anxious for it appears that he did not want his brother W B Sayers to have his property so when the lawyer failed to come he sent for him the second time When he camerecognized him and told him he wanted his will written There is conflicting evidence as to whether or not his property had to be suggested to him by the attesting witn esses buthe knew his property even though it had to be suggested as he willed nothing so far as the evidence shows that did not belong to him nor did he fail to will any property but what he gave his reasons for such failure When the si illwas finished and read over to him he said it was right The provisions of the will seem to ms perfectly con sistant and the evidence shows that during his sickness he recognized his ucigliDors except in one instant
