the vacancy in that of fice created by the election of Mr Beck ham to the office of Governor The Constitution does not say any thing af the kind but on the contrary says many things that ioiply the reverse It says that the Gov ernor shall have power to fill all vacancies except as otherwise pro svidrd by the Constitution until they sare filled according to the provisions ciFtTie Constitution So far as this matter of filling the vacancy in the office of Lieutenant Governor is concerned the present Constitution is the same as that of 1850 only it ds a little more specific The Contitution provides that n case of a vacancy in the office ol Governor the Lieutenant Governor shall perform the duties appertain ing to the office until a Governor be elected and qualified or his disa bilities be removed It makes minute provision for the election of a President pro tern of thc Senate and for another election whenever a vacancy occurs It farther pro vide that the President pro tern of the Senate shall discharge the duties ofGovernor when the offices of Governorand Lieutenant Gov ernor are vacant It provides also for the election ofa Governor when a vacancy occurs before two years of this term have expired No similar provison is made as to the office of Lieutenant Governor More than this the Constitution makes further provision for filling thr office of Governor in certain contingencies If there is no Governor Lieutenant Governor or President pro tern of the Senate the Secretary of State is required to convene the Senate to elect a Pres dent and until a President is chos en the Secretary of State acts as Governor If there is Secretary of State the duties imposed on the lat terin case of vacancies devQlve on the Attorney General All of which tends to show that no election by i the people to fill the office of Lieu tenant Governor is contemplated The practice under the former Constitution was not to hold an election and if it had been the in tention of the farmers of the pres- entt Constitution to change the practice tbev would have said so in language not to be mistaken In stead of this they contented them selves with reducing the age re quisite from thirtyfive to thirty yearsj and making more elaborate provisions for electing a Presi dent pro tempore of the Senate COurier Journa- lDcEiiBER3rdisthe day when the State Board of Election Commissioners will meet to count the official vote of the different counties through the state While it is couceeded that Beck an1 has carried the state by a handsome ma jority and that nine
