and good order justify calling out troops on election day Mr Weaver said that owing to incendiary speeches and publications in the newspapers thero was a feeling of unrest but not such he thought as Williams order appointing Mr J N Brown Judge Williams takes the position that the power of appointment is vested in him andnot Gov Taylor and hence he refused to approve his Evans bond and refused to permit him t be sworn in although he Presente a splendid bond signed by goo men This question is a new onto the Kentucky bar but he gar rather a lengthy oral opinion from the bench after Messrs Brown Williams and Lewis had argued the question giving his opinion of the Constitution applicable to the apt ointment and the various sections of the Statutes and acts relatin thereto He founded his opinio- on section 152 of the Constitution which pi ovides that the Governor snaIl fill all vacancies for the State atlarge or for districts larger than a county Then the Governor under this section has no authority tofill any vacancy tin any district lessthan a county which this is Section 1527 Kentucky Statut- a vests the power of appointment in the County Judge while Section 3758 gives the
