according to reports now being circulated it was not write this card to correct these untrue re portsMy information is that it is being told that Mr McCarty submitted to me since the decision of the court a prop sinon to recount all the ballots ai that If 1received a majority and thought I could not win that he wou run the race out and make a bond to turn the office over to me No such absolutely ridiculous and illegal une forcible proposition was ever made tome It is also being reported that Mr Mc Carty has since the of the court offered to do what I sought by the contest and that I roused his offer I desire to state that this report is alsoI untrueThe facts are that two gentlemen did come to me and ask me if I be satisfied to let two persons already selected by them count the ballots in my race in the Klngsvillo precinct I do not remember that Mr McCarty name was mentioned by them It was not coupled with any statement or agreement that I should have the certificate of nomination In case a major- Ity of the ballots were for me It was not proposed that theso two men shoul check the vote in the sheriffs race with the stubbook and it was not proposed to give them any authority to anything except count the ballots as fount in my Face Of course I never considered such an empty proposition It was a most palpable attempt to the damaging effect of past unfair conduct and evidently just made to be the basis of a campaign story I was seeking br my contest a recount of the ballots I was seeking to obtain the certificate of nomination to which I was entitled Before I filed my contest I offered to submit to and abide the result of are count of tho ballots This was refused I mado the same offer before the contest committee This was refused I- sought the same thing by my suit Judge Bell ordered the committee to hear the contest This judgment was appealed and reversed After all of thla I hardly think any person would believe these false reports I wan the party to know I have betn willing from the date of the primary to abide the result of a recount and sought to obtain it in every poslble way It must strike any fair minded and just person that propositions of my opponent coming at this day an void any sincerity and made only for political capital M S BAUGUMAN P SSlnce writing the above card- I have seen the affidavits of Geo L Penny and B W Givens They fully sustain what I have stated above The emphasize my contention all througl this matter and that is that the Com mittee were determined not to coun the ballots since at the time this proP- osition was made the Committee full and complete authority to coun the ballots and issue certificate I hay nlso seen the affidavit of Thos Shanks I am not concerned in what took plat in the meeting of the nominees It shows however that the people of the county were anxious to have the ballot counted and were demanding fair play Messrs Penny Givens and Shank Answer Mr Baughman by Affidavit The affiant B W Givens says tha the statement hereinafter made by him is true The said statement is as follows A few days before the date when the Court of Appeals decided the case of JcCarty vs Baughman resen Democraticat a conference of the nominees held in Stanford Mr W L Me Jarty was present We were discussing the contest for the nomination foi sheriff the probable decision of the ourt of Appeals the result thereof Mr McCarty to all those present hat ho believed the Court of Appeals would decide for him but that he would not be driven to consent that the ballots should be counted he did not want the nomination unless he had a majority of the votes cast that hould the Court decide for him as he believed it would then when his legal to the nomination was no lopger thathetM count should show that Mr Baugh man had received a majority of the otes he would surrender to him the omination vote for him and do all In- his power to secure his election It was then suggested that in view of Mr Baughmans hostile attitude toward other Democratic nonlnees as wells McCarty he Baughman could not- win if he had the nomination To this Mr McCarty responded that he would be willing if the count showed Baugh man to be the nominee to either let- It Baughman go on the ballot by pe ition or run as the nominee himself and if he shonld win he would turn the office over to Baughman A few days after this I was preparing to go to Lancaster when I was by Mr Baughtnan who had heard what had transpired at the conference mentioned above He asked me if it were true I told him I would lee him later and talk to him I hur led to go toLancaster and left at once At Lancaster I saw Mr Baughman who had there as I had to at tend afuneral He had said to me in substance that he would be satisfied if he could secure a count of the ballots in the Kingsville Precinct I told him to see Thos Shanks and Shanks would tell tim what was to be done Afterwards on County Court day in this month I saw Mr Baughman on the streets of Stanford and talked with him about the matters heretofore men coned I told him that Mr Penny the hairman of the county committee and I wore authorized by McCarty to say hat he would consent that the ballots In Kingsville should be counted this ount to be made by Mr W M Bright cashier of the Lincoln National Bank and Mr J S Hocker President of the First National Bank in the presence of the chairman Mr Penny My first- roposition was to count tho ballots in BaughmanMcCarty race Mr Jaughman said he would not be con tent unless the vote in all races in that irecinct were counted I suggested hat there was no necessity for doing this but after conferring with Mr Penny 1 went back to and said that the vote of every candidate for office might be counted To this his response I say it wont dome any and I wont count until after the election With this he walked away and we had no further conference on the subject named- B W GIVENS Subscribed and sworn to before me contest by the court of appealfMr Baughman came to my ana me he would like to see the ballots In his raco against McCarty I told him that I did not know what right I would have to go in the ballot boxes which were in my custody as chairman of the Democratic Committee but that 1 was disposed to grant his re I would ask Ie advice asithatgal to the boxes and ace him again I consulted an attorney who advised me that I would have no to into the ballot boxes until the mandate of thocou of appeals should be issued and that would not be issued un til 30 days after the decision of thetas unless the to the suit would agree My information was that 30 days were allowed to the defeated party In the court of appeals in which to a petition for rehearing and that this was the reason why the mandate woul not be issued unless all parties should consent This case was decided about Oct 2 On Saturday following the Thursda saw Mr Baughman reo ported to him the advice I had receive from counsel and said that if he woul consent that the mandate of the court of appeals should be issued at once I open the ballot boxes and allow a count to be made My impressio was that he desired a count of the ballots in the Kingsville precinct I suggested that neither he nor McCart ought to be present at this count but that it well to have Mi Bright cashier of the Lincoln Nations Bank and Mr Hocker president of the First National Bank as report would be credited by every one I stated too that in view of the fact that the ballot boxes had been in my custody I would be present at the count to see that the ballots were in tho same condition as when delivered to me Mr Baughman then said that a count would do him no good and that he did not want one now but would wait until after the election- I had no further conversation with him on this subject On Monday fol lowing this Mr B W Givens reporter to me that he had talked with Mr Baughman and that Baughman wanted the ballots counted in all the committee or some reputable men In the county should open the ballot boxes and count the ballots and then publish the osult If it shows upon a count that llauRh nan Is the nominee I will cheerfully work lor and support him and do all In my power foe him as well as the entire ticket Borai of those present then suggested that inas such as Mr Baugbman was not only Ope poling McCarty but some of the other nom neos about whose nomination there wee IK ontrorersy or question they did pot ba eve that Baugbman could stow successful Iy head the ticket and run the race There wal then some discussion as to the legal right of tbe committee to open the ballot oxen while the case was undisposed of in the Court of Appeals or in the Interval blob would occur between the decision of- tbe case and the Usual of the mandate It as suggested that Mr Baughmnn con lent would be necessary to the issuing of- the mandate Immediately Mr McCarty tben said that if the count should show that laughman was the nominee ho McCarty would either withdraw as the nominee and let Mr Baughman go on by petition or be would run the race out as the nominee and urn the office over to him if he McCarty lionld be elected On the morning of October 6th Mr Hough mOD came to the new courthouse building where 1 was and in substance made the fol wing stamements to me I am a Democrat and have always been a democrat and would not for any consideration change ny rinclples What mates me mad Is the lies rate of these follows tell on me They say I amino combination with nell and we 11111 divide the office You know this is not true
