Democratic County Committee to the contest of Mr McCartys j right to a certificate of nomination for I Since writing that paragraph we have seen tho full opinion of which sustains the action of thoI IIdemurrertho contest tho court to 88tBaughman gave to his successful opponent a notice of contest InIwhich ho stated that the officers oCI the election and tho committee hadI wrongfully counted more than 200 illegal votes as having been recelvj cd by McCarty giving the namesI of tho voters in each precinct and I the reasons why thoy were illegal McCarty answered tho notice of contest by a counter notice in which he denied that 200 or any il legal votes had been cast or count ed for him In the primary and de nied specifically that certain voters were illegal for the causes named or for any cause He agreed with Baughman that certain other voters named in Baughmans notice of contest wero Illegal voters but denied specifically that they voted for him and alleged that they voted for Baugh man McCarty alao gave tho names of many other persons and alleged that they were illegal voters nndI that they had voted for Baughman at tho primary election Ho UegedI that his real majority over Baugh man was much greater than reportI ed by tho committee Tho county committee met on a day fixed and adopted rules for the contest and on that day after adopting the rules McCarty by counsel filed 11Jdemurrer to Baughmans notice contest Argument of counsel forI the parties on this demurrer was commenced before noon and resumIcd and finished afternoon the argument the committee left tho court room and wont to the clrICUlt court clerks office to consider and decide tho question submitted After considering tho matter thoccommittee decided by a voto of auv en to five to sustain the demurrer and dismiss tho proceeding There was no effort by Buughman or his counsel to file an amended notice or pleading Further along and referring to Daugh mans charge that the committee had failed and refused to give him a trial his contest tho court days There can be no doubt that the committee did meet and act as a body upon appellee Baughmans contest by hearing and considering a demurrer filed to his proceedings which demurrer they sustained and dismissed tho contest This ended thIS matter in so far as tho commit tee is concerned This court has no power to review tho action of tho committee Referring to Biughmans contention that tho committee should have opened tho ballot boxes and counted tho ballots i because a petition of 10 per cent of tho voters in certain precincts had request ed that this be done the court says The difficulty In tho way of Baugh man is that he did not make these petitions a part of his noticoor pro seeding ho did not refer to them in any way so as to give the commit tee notice that he relied upon these petitions to aid him In his proceed ings And further THKBB WAS NO CONTEST ntOCBEDING TENDING WHEN THESE fETITlONS SIGNED BV TUB VOTERS OF TUB THREE rilE They may bo good things but certainly they are not pretty They are Northern in ways and Northern in looks and have that morsel appearance that does not appeal to a fellow wives ho l among the Lords most beautiful A handsome Carnegie Library is one of the sights of Martinsville and her people are justly proud of the instil lion It was built at a cost of 50000 and is filled with books and periodicals There isnt a hill in Martinsville and it covers a great deal of ground but knobs or small mountains can be seen any way you look A largo river runs through the pretty valley and the town gets her water supply from it I have found a number of people hero who remember Mr Thompsie Cooper who was here twice for eczema He made a splendid impression hero as he does overt where The employes round the Martinsville Sanitarium where he stopped all send their regards to him and say they wish they could vote for him Nov 2 I have pictured Martinsville as best I can but it is not my intention to throw any bouquets to the town The place may and doubtless does suit many people but give me Stanford I would not give the delinquent tax list of dear old place for all the Martiavlll- this side of month off and now is the time to perI fect an organization No party nor person can win without an organization where the contest is anything like close We know the republicans are organs ed for they of democratic ad ministration there has not been a cop illegally and we might say wrong ully appropriated No smell of taint is foundon the garment of a sing ledemocrat who has held office in county in the recollection of the writer who has taken notice of things for past 30 years Questions of pith and moment have been well handled by the democratic fiscal courts the judges itsheriffs clerks and other officers have given clean economic administrations The pikes have been bought and freed with very little burden to the tax payer thecourthouse will soon be completed nobody has been nor will be injur edjjy the 35000 expended in its construction Other propositions have been as judiciously administered and democrats have done it all Why hewant to turn them out with records fiaThe republicans per sonaliy interviewed the members of the alt8CaptHerndone of committee that it nominate him then was and there This the committee could not legally do because the State law gives to the committee the power only of fixing the time and manner of rank ing party nominations The commit tee however offered to callaconvon lion of tho party for the purpose of making a nomination but this was not agreeable to tho captain He seemed to be apprehensive that the republicans of Garrard his own county would throw him down And thus the mat ter ended with nothing done In the meantime the captain got busy solicit ing voters to sign a petition asking him to run in defiance of party regularity It is an easy thing to get some people- u to sign a petition to pardon a convict or to ask a fellow who is spilin for a job to run for an office But it does seem to a plain man that where the of fico is one of dignity and high import ance and there are respectable and Ins fluential party organizatipns charged with the power of making nominations a man who appropriates the device of one of these parties to further his own ambition not only forgets the dignity of the office but stabs the party whose
