editorials The reason is that its editor hates Gov Beck ham and is small enough to show it in this puerils way In his support oC Gov Beckham Editor W P Walton also incurred the enmity of the great sheet and his retirement from editorial work after 30odd years is not regardw as worthy of notice This is peanu journalism with a vengeance The CourierJournal can not ignore Gov Beckham to the latters IAIIRODSSURC May 5 1909 In the card published by Judge Owe ley In the Advocate of April 28th and tho INTERIOR JOURNAL of May 4th he refers to the position I took in the joint discussion at Lancaster on the subject of an amendment to the Local Option law by which if enacted the purchaser of spiritous liquors in those distric where the sale of it is forbidden by law would bo subjected to a penalty equal to that imposed upon the seller It is true that during that discussio I then expressed and do now express my belief that such amendment would be more effective in the destruction of Blind Tiger traffic than the existing law which limits the penalty to the Bel er Judge Owsley commits himself to tho role of a prophet rather than a jurist and with unclouded vision foresees that this amendment would multiply beyond measure the number of blind tigers and increase by a thousand fold the whisky traffic in the district Bold words these but if they be the offspring of inspiration rather than the exuberance of a stimulated imagination they must be accepted as true It will however strike the public as an unusual dispensation of Providence that such gift of clairvoyance has been con Cered on Judge Owsley when it has been mysteriously withheld from the membership of so many legislative assemblies of Kentucky in the enactment of law upon kindred subjects Has it multiplied the number of duel and voluntary fights in Kentucky because all the parties participating in such encounters are made under the law equally guilty JHas it increased gambling for money or property because all the parties to the game are subject to equal punishment T Has it Increased the indefensible practice of buy ing and selling votes at popular elec tions because the seller and the buys are equally penalized T Has it increase the disreputable practice which one prevailed of selling and buying the rewards and profits of a public office be cause of the law which imposes a like penalty on both buyer and seller 7 Hai the betting of money or property upon the result of popular ejections been in creased because the Legislature enacted that parties to the bet shall pay a fine T Has the betting on games played on licensed billiard or pool tables been Increased because the law imposes a penalty both on the owner of the table and the person who makes the bet T Has the violation of the 7th commandment been increasedlbecause both parties tithe forbidden act are punishable at law When these and many other questions of like import may be truthfully and affirmatively answered then the public may be forced to admit that the former Legislatures of Kentucky have groped In uninspired darkness and that a new prophet has arisen in Israel II Descending from the exalted plane of prophesy Judge Owsley is pleased to assume the role offjurist and to adjudge that by putting a penalty on the buyer as well as the seller of liquor it takes each of them incompetent to tes tlCy against the other because neither the seller nor the buyer can be made be Core the court to give any information which would incriminate himself before consideringthe legal phase of this point it will not be amiss to note the logical result to whichit tends The rgument is that the buyer of liquor II legally sold should not be punished bylaw because the seller couldnot be re quird to testify against him Would Judge Owsley orthe public have the legislature to repeal the existing laws- on the subject of dueling mutual combats gaming and all other crimes and- mlsdemeanorswhich can not be com mitted except by the concurrent acts uf not fewer than two parties T And yet the identical principle ho invokes applies to all these cases There cannot be an illegal salejof I liquors unless there be a purchaser It is the act of the buyer which makes the business profitable If arestraint be thrown on the buyer it necessarily affects the business of theseller III While it is fundamental law that no mean bejrequired to testify against mach it is not the law that he may not be forced to testify against another though his testimony may tend to incriminate himself if the Legislature should provide that his own testimony against another shall not be used against himself In the chapter of the CentuckyJStatutes against ganing it Is expressly provided that in any prosecution for a penalty against gaming it shall bono exception for a witness that his testimony may incriminate limself but nolsucb testimony shall be used against him in any prosecution except for false swearing pr perjury Jo therefore if the Local Option law should be so amended as to penalize the buyer nsjwellas the seller with the ad lition to It applicable to gaming the buyer could In a prosecution against is the sellerlbe introduced as aaitaes and thenln turn in a pros cutlon against the buyer the seller could be introduced against the buyer ThIs would be an easyitask for the Legislature and by thecnactrnent of such law the guilt of both parties to an Illegal transaction could be legally shown IV Ifll may be allowed to indulge a reasonable conjecture based on certain trials which have recently taken place in the police court of Stanford and also on the common observation of many people in the community I would sui mice that Judge Owslcy may have some interest other than a patriotic conch oration of the public welfare whit constrains his opposition to a penalty against the Ipurchaser of blind tiger whisky A pointed reference to this interest wasjmade by mo in his presence at our joint discussion and will be adverted to more specifically in the speeches I propose to deliver in Lineal and other countie- sQuestionsof legislative policy are really not fit subjects for consideration in a contest for a judicial office but Inasmuch as they have been injected by Judge Owsley into this canvass more particularly in his oftrepeated private talks I resolved tol declare my own views publicly Referring to his boastful declaration that he has voted for local option in Lincoln county 1 will not deny it for I do notknow However it is no uncommon thing for peoplemot over astute who an seeking some personal preferment from the public to become sudden advocate of an attractivelmoral sentiment There is nevertheless a distrust of the sincerity oftone who preaches morality and practices immorality of the sincer- Ity of the rampant temperance man who votes dry at the polls and retires to his office and votes wet out of his bottle There is also a distrust of one whose reformation if it has at all occurred is coincident with his candidacy for office It may be that one may jump immediately from the swine trough to a feast of the fatted calf but when it comes to tho point ofj seeking credentials for apostleship I take it that the people would prefer that he should tarry awhile atJJerusalera to wait for power from on high In our joint discussion at Lancaster and at Harrodsburg I asked Judge Ows ley to say whether or not it is true that he voted against Wm Goebel and af terward declared that Goebels assaslns ought NOT to be prosecuted whether or not it is true that he refused to vote for Gov Beckham and whether it is true as reported that he used his influence to induce Mr J N Menefee to accept the republican nomination for sheriff four years ago when the present sheriff Mr T J Hill was the democratic nominee for that office He did not then nor has he yet to my knowl edge denied any of these reports and I shall in the speeches I propose to make again ask him to answer As I take it in a race for a democrats nomination it is of more importance to a candidate to show that heis a dcm jcrat than to vociferate about his very questionable record on the temperance juestionSJ Judge Owslpy but recently accepted ray invitation to a series ofjoint discussions but after one meeting in Lancaster and one in Ilarrodsburg for some eason unknown to me he abandoned hem and made conflicting appointments for himself to which I was not invited and beside published his screed in the Advocate and the INTERIOR JOURNAL to which this is but a partial response I propose to give to any one who may Ceel sufficiently interested an opportunity to hear my views in a series of public speeches to be yet delivered and I again respectfully invite Judge Ows ley to be present assuring him 13th Judicial Dldrlctmadeby the Democratic Committee 1 A primary election is hereby called to be held in the several voting clncts of Lincoln Garrard and Mercer counties between C A M and 4 r M on 15
