majority of the county committeeII have always been a consistent dem ocrat and when I announced myself aI candidate I had a right to suppose that r I would be given a square deal by theI party authorities whether they happened to be for or against me in my race So when I was approached by aI presentthenatsea henchman of my opponent and his services tendered me to get my friends on the county com F mittee I spurned his offer with the Statement that I would engage in no such fraudulent conduct that I was on ly entitled to a square deal and would certainly not compromise the honor of any friend of mine by asking him tobe a member of the committee in order toI act for me right or wrong I ltedI strictly in accordance with these views 83 I neither took nor attempted to take any part iu the selection of the county f committee I do not regret my course i in this matter even though It did costI me as subsequent events show theI nomlnntionfor sheriff When thcjcommittee met to select the officers of election I submitted as j requested a list of names of persons competent to act as such The committee appointed 48 election officers yet out of this umber only 15 were fa Jrlyti chance since even according to the r fraudulent election returns there was a difference between us of only 14 votes f 4 in a total of over 2100 1 made a careful canvass of the coun ty andibelievcd a majority of the dem ocrats were for me So when it was reported that Ifwas defeated by 14 I avotes I determined to look into the f matter Upon investigation I was con winced that I hadjfairly won tho nomi nation and had been deprived of it by 1 t rr rf J I fraudulent votes and fraudulent count I then proposed to my opponent Mr McCarty that we agree to lot the com mltteecount the ballotsland abide the result No one will say this was not a fair proposition He finally refused to make any such agreement Still having some faith in the fairness of the committee ifilcd before it in the time and manner prescribed by law a notice of contest I stated that 1 had been fairly nominated and charged that the ballotalhad been fraudulently counted and thatjthe ballot boxes them selves contained the evidence of and would show too fraud practiced upon me and I demanded an examination and count of the ballots by the committee I furthercharged that numbers of illegal votes had beencast and count ed for Mr McCarty in the various pro civets of the county and gave too names of the illegal voters in all over 200 I further charged and specified other fraudulent and illegal acts in particular wadthis notice Mr McCarty filed on lag Monday a demurrer and an answer an counter notice The committee was called together last Saturday and the case tried tho the issues were not made not a parti evetn time for taking proof had not arrived The case was tried however that is if otthe committee to hear my contest a- properlyall a trial The only question before the committee on last Saturday was the objection by demurrer to my notice of contest For the purposes of the trial of this question it was admit ted that the ballot boxes were stuffed with fraudulent votes for Mc McCarty and that an examination and recount would demonstrate that I was nomi natedfor sheriff It was likewise ad mitted that over 200 fraudulent and il legal votes had been cast and counted for him Yet in the face of these ad mitted facts the committee was urged not to try the contest and by a vote of seven to five it so decided Only T A Rice W L Bell Wm Holtzclaw J M Cress and Wm North were willing to give me a square deal The other members of the committee were determined otherwise It was contended for Mr McCarty that the committee hart no right to count the ballots A most nonsensical contention since if the bal lots can not be counted in a contests what is the sense in that provision of the law requiring them to be scaled up and returned Any port in time storm and anything to give willin minds some excuse It wad also contended that my charge ns to fraudulent ballots in the boxes was not sufficient in detail yet I charg ed that in the various boxes there were ballots cast for me and fraudulently counted for McCarty I certainly could not know exact number in each providesrthat the committee shall count the bal lots in any precinct upon a petition signed by 10 per cent of the voters therein In order that the committee might not have even a pretext to refuse a count I filed within tho time pre scribed such petitions from Stanford Precinct No3 Waynesburg Nos 2 and 3 and Hustonvillo No 1 Yet upon these petitions the committee refused to count the bailotsin these precincts A majority of thccommittee was sim ply determined not to open the ballot boxes and uncover the fraud Again even if this one paragraph of my notice was insufficient that could not affect or invalidate the nine other paragraphs wherein I charged in each more than enough fraudulent and ille gal votes to give me the nomination and to which paragraphs there was not even a feigned objection Notwithstanding these facts a majority of the committee upon a mere pretextI use tie word advisedlydismissed and absolutely refused to hear or try the con testI offered before the committee set tie and determine the contest by a count of the ballots I made this offer publicly before the committee and di rectly to Mr McCarty and repeated it and he sat dumb This offer was fair and his failure toI accept it or allow his partisans on the committee to act upon it is proof con elusive of my charge and demonstrates that I was fairly nominated and fraud ulently deprived of the nomination He knew a count of the ballots would show the fraud otherwise he and his would certainly have consented to and acted upon my proposition The above are the plain unvarnished I facts and I submit them in order that you may know that while I am the victim this time of the4raud you may be the next unless such practices are ef fectively
