Ask For 3 zS THERE are several ways of doing business One is to put off court A necessarily brief review of the opinion shows that tho court holds the State must pay back all but forty two and one half cents on the Beventy five cents tax received from banks for fouryears past and that all the banks are Bubject to city and county bank taxes for these years The decision of the court effects every bank in the State It reverses the previous decision which held that banks should bo taxed under the Hewitt law and subjects all banks to the ad valorem tax The facts in the case in brief are that in 1885 the Legislature nassed what is knowu as the Hewitt bill Re cording to which the banks were to pay to the State 75 cents on every 100 and were not to be subject to any other taxation This was accepted by the banks and a contract entered into But iu 1893 the Legislature did away with the Hewitt law and passed a bill taxing the banks according to the ad valorem system without deducting debts The banks contested this and they were sustained in their objection by the Court of Appeals which held that the Hewlitt law should hold But a number of banks have been formed since 1886 when the Hewitt law was passed and these are subjected to the ad valorem tax They sueu noming tnat they should not be taxed on other conditions than the old banks These are the cases tlut were decided to day Tho Court of Anneals Iibb been changed since 1895 and the decision to day not only holds that the new banks shall be taxed on the ad valorem system but also reveises the previous decision holding that the Hew itt law is unconstitutional und that all banks shall pay an ad volorem tax Whether the banks can be mado to pay back taxes will have to bo decid edly further litigation In all probabilities the case will be further contested and the case will be taken to tho United States Supreme Court J ho House roll call was watched with even more intorest Baldwin Napier and Nanco voted for Boyle the
