had been exhausted in the effort to preserve the peace the troops were not furnished iesterday a reporter learned that true to his word Judge Finley did not hold court in either Letch- Â¬ er or Knott county After leaving Pine ville where he presided over Bell circuit court he went to Harlan Court house where he is said to have remained upon the bench one day The attorneys got together in Knott and Letcher and elect- Â¬ ed Col J B Dishmau Barbourville special judge Judge Irishman convened the court at both county seats and tried a few cases without trouble At Whites burg Letcher county however a man was killed during the session of the court Judge Dishmau being a prominent law- Â¬ yer was engaged in most of the large cases and of course all these had to be continued The reporter was informed that Governor Knott will soon appoint a special judge to try the remaining cases A spe- Â¬ cial term must be called for this business and it will prabably be done some time in September Many people who have censured Judge Finley for his action in this matter have wondered why the gov-Â¬ ernor did not take this step sooner That could not be done however said the reporters informant until both the presiding judges had refused to hold court and the bar had failed to elect a qualified special judge This has now been done aud the governor is free to act The punishment of crime is vested with the civil authorities he continued It rests almost entirely with the circuit judge and Commonwealths Attorney and not until they refuse entirely to do their duty can the executi ve interfere In this district H C Eversole is the commonwealths attorney and through cowardice or some other reason he has left most of the work in the troubled section to be performed by substitutes when it is done at all In the five years he has held office he has been at but two terms of the Bell circuit court and it eems that he did not pretend to go up iuto either Harlan or Letcher As both he and Judge Finley and in spite of fine cultivation the cockle burrs made heavy growth ren Â¬ dering the gathering of the crop anyÂ¬ thing but a comfortable task Early in the spring the ground tvos thoroughly plowed and oats sowed broadcast and welliarrowed in and then rolled so as to get as level as possible The cockle burrshad just got well started to growÂ¬ ing when the oats were cut so that when the oats were taken off they had a fine chance to grow When they were beginning to form burrs a liock of sheep was turned in upon them and kept there until in September when the ground was thoroughly broken and seeded to wheat No burrs grew to mature seed that fall The next year as soon as the wheat was taken off the ground was thoroughly plowed Later on a socond plowing was given and then j0wasw thorough v
