The in an exCourt of Appeals haustive opinion by Judge Settle in tho case of W. C. Madden against Pat Mcehan, from Jefferson county, holds that a policeman has nfc power to make an arrest without a warrant unless the offense for which the arrest Is made is committed in the presence of the policeman. Madden sued Median, a policeman, for arresting him without a warrant on the charg0 of keeping a disorderly house. Madden had a pistol on his person when arrested and as 't w'as shown that the charge against him was carrying concealed a deadly weapon, the court says he is not entitled to damages, as a P liceman has the right to arrest a man who is carrying a deadly weapon.
