Turns Up Much Alive RIVER WAS DRAGGED FOR HIM Frankfort Ky Dec HJohn- R Fallis who was supposed to have been blown up by dynamite Sunday night and for the recovery of whose body from the Kentucky river his administrator offered a reward of 250 arrived home safe and sound tonight after fleeing all the way to Jacksonville Fla under the delusion that he had thrown a box of dynamite among a crowd of people and killed them He read In a pa per at Jacksonville just as he was about to take a boat down the St Johns river for the ocean that he was the only victim of the tragedy So he retraced his steps and walked In on his overjoyed family tonight at 9 oclock V Fallis was carrying a box of dy namite from his store down to a shantyboat on the river bank last Sunday night when he stumbled and dropped the box Ills wits and daughter heard the explosion and rushing down the path to the river found an Immense hole blown In the bank but not a trace of Fallis The next day the river was drag ged and later an administrator was appointed who offered 230 reward for the recovery of some portion of the body as Fallis carried about 3500 life insurance The reward stimulated rlvermen who have been Industriously searching the bank and depths ever since for the body Even as Fallis stepped Into his store tonight three grappling hooks and lanterns were engaged In the grewsome task While his wife and five children were mourning his supposed death and the administrator was taking an inventory of his estate Fallis was putting miles between him and the scene He had about 200 on his person at the time I was on the edge of a steep bank above the boat he said when I slipped and as I did so I threw the box from me down the hill I heard the explosion then I did not know anything until some time later I was bareheaded and cold and near the railroad Sever al people passed while I was there and every one was talking about those people being blown up with dynamite fThen I began to think If some one was killed I would go to prison maybe for life I started walking and made It as far as Christians burg where I caught the 2 oclock freight for Louisville I arrived there early that morning and farm ers for this loss to the miners has simply destroyed their market for the necessaries carried in stock by the merchant such as food and raiment This is not the only loss to the miner as we will show further on We will also try and show to I the public the great loss that the operators of these mines are con constantly undergoing from causes entirely beyond their control1 We will state that a coal mine stands alone and apart from any other Industry This Is especially sO from the operators standpoint being at the mercy oV the railroad corporations and the combines Indifferent cities anr towns so far as prices are concerned Every coal mine must be cared for during Idle I days The mine must be kept in times in the readiness at all expec- tationI of getting railroad cars The roads must be clean from small I dropping falls from the roof here and there the water must be ball ed and the pumps must be kept go ing to lift the water out of the mine or the mine would be flooded =there can be no compromise with water The ventilating machinery must be kept running several hours every day However this Is some what neglected on account pf the great expense for engineers and pre men This Is where another loss to the miner comes In When mines are Idle for several days the fans and ventilation are to some extent neglected thereby causing an accu mulation of1 gases which are posi tively mules This Is a dally cost run or no run Added to this also Is the great toes of profits Wo may point out another source of loss Some of th operators or all of them at UmeSI are compelled to buy coal eibewiieiv for the purpose of holding their contracts so that they can run the mine whdh the railroad company says they may run by putting rail road cars on the mine switch In summing up we may safely state the loss to the coal industry In Ohio county alone will amount tithe startling sum of 350000 In four months through shortage ol cars From those figures we may learn that while we miners and op differIencesthose differences for the time bein and work In harmony for the safe ty to health life and property and the welfare of the coal Industry In Kentucky Furthermore we de sire It to be plainly understood by both the press and the public that We are in this movement as citizens of the great State of Kentucky And we as miners of Ohio county peti tioned the Governor as citizens ol Kentucky We have appealed to the people of Kentucky through the press to agitate intelligently for laws that will not only protect the coal Industry but aU other Industries and the general public from being put at the mercy of the great corporations trusts and combines We wish It to be further understood that we the committee represent ing the miners of Ohio county and their families are all staunch sup porters and members of the United Mine Workers of America However In this movement we wish to be known only as citizens of Kentucky Our petition to the Governor was backed up by a petition to the Rail Frankfort Ky Dec 13The Court of Appeals today in an ex haustive opinion by Judge Settle in the case of W C Madden against 1 Pat Meehan from Jefferson county holds that a policeman has nfr pow er to make an arrest without a war rant unless the offense for which the arrest Is made committed In the presence of the policeman Madden sued Meehan a police man for arresting him without a warrant on the charge of keeping a disorderly house Madden had a i pistol on his person when arrested and as It was shown that the charge against him was carrying concealed t a deadly weapon the court says he4 4Isnot entitled to damages as a po- iF llceman has the right to arrest a iF on man who Is carrying a deadly weap The opinion goes further how ever and says a policeman has no I I more powers than any
