announced at any time Events of the republic seem to be shaping themselves Inevitably t rrapidlyin that direction t The Mexican Congress was con vened today In an extraordinary f session to meet the emergency con fronting the Government The con stitutional guarantees throughout the repnbllcwere suspended This Is equivalent to the establishment of martial law and the change from J the orderly method of conducting the Government to the strong arm of the military Is an admission that In ternal conditions are extremely grave This one official act more than anything that has yet occurred cor he judgment of the Ohio Circuit Court was reversed in the case of the Green River Chemical Company against the Board of Trustees of the own of Rockport The Chemical company had secured a deed to tract of land to erect a wood alcohol actory and if the site was not used for the factory a fixed number of ears it was to revert to the peopled the city who had donated the money and the court holds that Suspended Stephensport Bank MOST GLARING CASE OF LOOT Banks Attorney Found the Holdings of Fleeing Cash ier a Myth DEPOSITORS VERV HARD 1111 Stephensport Ky March 11 Developments here since the closing of the Two States bank on Tuesday of this week and the departure or disappearance of Cashier John S Adair show that the bank was con pletely looted before It was closed There was practically nothing left in it and even the young lady Miss Payne who was assistant cashier os well as her mother had all their savings In the bank and the prob alllone Is that she did not know of the bank being Impoverished though she was In charge of the bank often alone while Adair was absent oii other en terprises or away at Hawesvllle or Owensboro to both of which places he often went This tact is also deeply humiliating to Miss Payne Orlando Smith who was the heav lest stockholder In the bank after Cashier Adair is frank in saying that the bank Is ruined and also gives out the fact that several of tie stockholders are utterly Insolven find good for no amount much less for the double liability The proba bility Is now that the 27000 at first given out as the amount of In debtedness contracted by Adair through others but practically all or which Is supposed to have gone to Ills purposomay be trebled when all revelations are made It is now known here that tho directors were averse to Adair Coffman of this city went violently insane today when Informed by the officials of the Institution that the child was dead She was placed In a strong ward and Is in a precarious condition tonight- A riot was narrowly averted bv the timely arrival of the police di rectly following the accident Tluetlittle Coffman girl was playing In Central avenue when the machine owned by Mrs W A Leech of Nor wool ran her down The car was occupied by Mrs Leach a daughter and her maid The accident hap paned in the center of the Jewish section and a body of men attacked the car after the childs body had been were Introduced to prove the In vasion of the city by a masked and armed band the burning of proper ty shooting Into houses wounding of men whipping of a tobacco buys nUll capture of citizens police sta tion tire department and telephone and telegraph offices Milton Oliver Testifies There was a buzz of suppressed excitement when Milton Oliver was summoned to the stand On direct examination he said he was CO years old wag now a resident of Illinois but with the exception of a year or two had lived all his life In Lyop county He had known Dr David A Amos four or five years He Ol a iver was a member of the night ri1 tier organization lie Joined at Nnbbs schoolhouse either in 190C or 1907 In the winter time Dr Amos ws not present the night of Ills Initiation The obligation was administered by George Brown The first time ho remembered seeing Amos at a meeting was InCedarGrove schoolhouse and he was Instruct ing tho have how to transact busi ness on different occasions The purpose of the organization was to have everything their own waytor Instance If a man would not Join the association to wait on him and see that he Joined Amos told them 41to go after a man right If he got mad and died it could not be helped He hall hoard Amos tell of plans to Invade Hopklnsvllle saying the city had Invited the night riders He told of the formation of two squads for the raid No 1 was com posed of Wallonia Lodge and No 2 of Nabbs schoolhouse and Cedar Grove Lodges No 1 was Instructed to capture the police station andNoHop ti Hoptithe first sQuad but coming Into town stumbled In the darkness and fell losing his place and attached himself to No 2 The two squads met at AVallonla about dark the night of the raid and started to Hopklnsvllle being reenforced on the way by sev r rni other squads After meeting at Wallonla ho said Dr Amos who 4 4was regarded as foremost man and lender Instructed the men as to de tals of tho raid he saw him no more until horses wore hitched out vldo of Hophlnsvllle where Amos lined up the night riders and gave them final Instructions He told of marching Into the city and the destruction of John C Lath rms warehouse Chairs end boxes were piled together saturated with coal oil and set on lire Outside the building the raiders under instruc tions discharged fire arms to Intimi date the citizens After tho build Ing was sot on firethe squad march ed to another warehouse and applied the torch Guy Dunnlnc one of the defendants was ho said captain of squad No 1 Hn had seen Dunning prior to the raid at Wallonla B Malone another defendant was cap tain of squad No2 ho said At VallonIa John Robinson he said was detailed to set fire to the Lath nm warehouse He said Newton Nichols and Irving Glass also de fendants were In the squad at the tires Glass had ridden homo with him the morning after the raid Ho beard It reported among the night- riders that Dr Amos had been shot r nnd that a Dr Hayden had carried him home The defense objected to the Introduction of testimony by Oli ver of what he claimed to have heard but the motion was overruled by the court Later ho heard some of the band say Be careful and dont get hurt for there is no doctor in the crowd Tie saw Guy Dunning again In tho gang which had been whipping Lind say Mitchell he said He did not re member to have been present at any night rider meeting with Dr Amos f since tho tight of the raid and had not since then heard him converse pbout the Hopklnsvllle Invasion CrosBoxamlned by Judge Bush Oliver said lie had joined the Farmers i Prolectlve Association after lead Jdlned the night riders Her 4beJ l v repeated practically All of his testimony regarding Amos and his connection with the band He admitted that testifying as a defendant In the Hollowell damage suit in Federal Court at Paducah he had sworn he wasnot a night rider had never been In a raid and never knew anybody who was a night rider He said he know Wallace and Arnold Oliver They wore his nephews He did not remember sending for then just before his Hopklnsvllle confession and denied he told them that ho was out 1000 or 1200 by the Federal Court trial and Intended to Indict a lot of fellows in Hopkins vllle and get back some of the mon ey He admitted he swore falsely in declaring at Paducah he was not a night rider Judge Bush produced an affidavit signed by Oliver who Identified hh signature It was read In open court and was a repudiation by Oliver of a confession made In this city It alleged that ho had been brought tc Hopklnsvlllo by Walter Krone and MaJ Bassett who told him they had nineteen witnesses to prove him a night rider and put him In prison un less he made certain statements that he sworq to some affidavit here the contents of which he did not fully remember but which implicated Dr Amos and others that he made the statements fearing he would other wise be sent to the penitentiary but he had sworn falsely and was not a night rider and never In a raid Oliver admitted he had signed this repudiation but said Its statements were untrue Questioned bv Stats Attorney Smith Oliver said he swore falsely In Federal Court trials because of his nightrider oath and that death was the penalty of Its violation He had repudiated his Hopklnsvllle con fession for a similar reason and at the repeated solicitation of John w1 Hollowell and Dab Nabb both of whom he said were night riders Tley knew he had been sleeping out since going before the Chris tian countv grand jury and told him It would be safe to return home he said If he slimed the affidavit they presented to him Oliver said that at a meeting at Nabbs schoolhouse just before Fed eral Court trials Amos had told numerous defendants to swear anything that would clear them The witness told of signals by which nightrider attorneys would know a member of tho band who was to be used on a Jury The attorney would put one hand to his collar and the juror If ho was all right would reply by a similar motion with the other hand Oliver denied that he had talked to Krone and MaJ Bassett Jointly ind said ho had come to Hopklns vllle by himself and because he had been summoned to appear before the rand jury- Judge Birkhead in all the rulings he has trade In the case against Tom Patrick in the suit brought against him by his mother Mrs Fannie Patrick The writ of prohibition grew out of the fact that Judge ON BY ENEMY Lexington iiMarch 11T B Whitson alias Sam Jones of Lctchei county was arrested here after hav- Ing been at liberty for sixteen ears since he escaped from the North Car ollna penitentiary at Raleigh wher- he had served two of his term o thirty years to which he was sentenced for killing a man in 1893I Whitson who has been living dur- Ing these sixteen years In Letcher county Ientucky where he wentt under the name of Sam Jones was considered a quiet thrifty citizen and had accumulated some property Chief of Detectives Malcolhl11 Drown received a letter severalI warderl t ing that he understood that i + was living In Letcher county under an assumed namethe letter also glv Jnra record of his sentence and des cription of the man Chief Drown i finally located Whitson as living under the name of Sam Jones near Whltesburg and learning that Whit son Intended to pay a visit to Lex ington soon Chief Brown waited fo Ills man to arrive Whltson reached here by train this morning
