In another county, where similar indictments were found, the companies were tried and convicted, but the matter has been taken to the court of appeals and Mr. Owsley tells us the cases here will not get to trial before the higher court passes upon the matter. Of course decision in those cases will cover the ones here and if the higher court reverses them it will knock these indicemens into a cocked hat. The court in an opinion by Chief Justice Hazelrigg, the whole court sitting, held the preferred stock of a building and loan association is not entitled to preference over the common stock, and that all stockholders, indiscriminately, share equally in the distribution of the assets of such associations, in the hands of an assign-e- a, in proportion to the amounts paid by them respectively in their stock. The decision was handed down in the case of J. K. Sumrall and others against the Commercial Building Trust's assignee and others, appealed from the Jefferson Common Pleas Court, and is an affirmance of the opinion of Judge Emmst Field of that court. The action grew out of the assignment, in June, 1897, of the Com mercial Building Trust to the Columbia Finance and Trust Company, of Louisville, and the question was in a suit brought for a settlement of the estate, and the lower court held as above. In affirming the judgnTent Judge Hazelrigg said: "We fully concur in the Chancellor's judgment denying any preference to'the preferred over the common stockholders in the distribution of the assets of the association. An unknown white man was found dead near the Illinois Central "Y" in the suburban portion of the city Monday nifjht at 11 o'clock.. Ho was a tramp and had been noticed ill in a box car during the day. One report is that he died of smallpox. Coroner Phelps was summoned and, is trying to get a jury. There is another report that he died from blows received. Great excitement prevails over the discovery. The man has only one arm. A case of smallpox was taken from the yard of the Rcddick River infirmary here Sunday to the pesthouse. The afflicted came in from Fulton, Ky., and had gone to the infirmary for treatment.
