McCoy Case Continued The case of McCoy charged with killing his fatherinlaw some ten years ago was continued until next court This is the second time the case has been put off The principal witness for the Commonwealth is Mc Coys son He was here first of the week but has disappeared and all to find him have been in vain The accused will now have to lie in jail until next court and mabe longer if young McCoy is not found Colored Recruits The War Department has wired Lt W T Johnston recruiting officer at Lexington Ky to enlist colored ap plicants for Cavalry and Infantry ser vice sending the INDICTED Insurance Companies Are hauled the Charge of Coiisitlrlcy As anticipated the grand jury re turned indictments against nearly all fire insurance companies doing busi ness in Lancaster Only those that are members of the board were includ ed in the batch the entire numberbe ing fourteen The indictment is as long as a wellrope and if put in type would make nearly two columns The sum and substance of the charge is that the companies have unlawfully conspired by persuasion etc to free competition among fire insurance companies and unlawfully creating a pool for the purpose of and fixing rates premiums etc among the fire insurance compa nies doing business in Lancascer The indictments are of the same character of those found in other parts of the stateThe companies claim that in order to fix their rates in an equitable man ner it is absolutely necessary to have these boards in each town in order that all companies can know the exact na ture of all risks they are asked to take The business men drew up and sign ed a petition to Commonwealths At torney Sam Owsley stating that as they paid the premiums they desired to be heard on the matter but the in dictments were returned just the sameIn another county where similar indictments were found the companies were tried and convicted but the mat ter has been taken to the court of and Mr Owsley tells us the cases here will not get to trial before the higher court passes upon the matter Ofcourse decision in those cases will cover the ones here and if the higher court reverses them it will knock these indicemens into a cocked hat Circuit Court Much civil business has been ed of in court this week and a number of little Commonwealths cases none of which were of importanca to the general public The case against Houston Clark charged with shooting at Henry Barlow was set for trial on Wednesday but was continued until next court on account of the absence of an important witness Owing to the bad feeling rendered a decision last week which will be of in terest to many people hereabouts who were roped in by Building and Loan Associations The court in an opinion by Chief Justice Hazelrigg the whole court sitting held the preferred stock of a building and loan association is not entitled to preference over the common stock and that all stockliold ers indiscriminately share equally in the distribution of the assets of such associations in the hands of an in proportion to the amounts paid by them respectively in their stock The decision was handed down in the case of J K Sumrall and others against the Commercial Building Trusts assignee and others appealed from the Jefferson Common Pleas Court and is an affirmance of the opinion of Judge Emmet Field of that court The action grew out of the as signment in June 1897 of the Com mercial Building Trust to the Colum bia Finance and Trust Company of Louisville and the question was in a suit brought for a of the estate and the lower court held as above In affirming the judgment Judge Hazelriggsaid We fully concur in the Chancellors denying any preference to the socalled preferred over the common stockholders in the distribution of the assets of the association The sug gestion that the appellees have not in fact anything into the concern on their stock is guarded against in teorders given in the court by proof ot all claims
