Decem I ber the 10th to be tried before Circuit Judge McBeath was called at seven 1 oclock Wednesday evening Feb 14th There was a large number of Oloverport people present including some of the moat ardent women workers Harding burg was also well represented by the good women and mdn from all over the M cou1y eagerly awaited the decision of the flidire XR The contestants were represented by 1 11Col David R Murray as formerly i ExSenator J 8 Wortham who was J employed by the contestees made a clear a and exhaustive exposition of the law Y and his speech bad a telling effect on both audience and court His tribute to woman and her work in the temper ance cause was appreciated Senator Wortham is one of the ablest lawyers in the state and is heart and soul In favor of the best Interests off the people When the speeches had been made and a short time had elapeed Judge Mo f Death handed in the following decision In the contest use of Thomas 0 Tou sey Ac aganet F N DHuy Ac from Oloverport the court being oufflcently ft advised delivered the following written r opinion y I agree with counsell for contestants that there exists such room for doubt aa to jpfttbe validity of the proceedings in the ewe under consideration as to render an appeal in the case necessary in order to have aach an adjudication of the question M will settle all doubt and place the law upon such a plain that it will be respect ed by all the people If it shall be held fto KVi kvalid The authorities cited by counsel seem a conflict and the various cases bearing upon the points at issue must be considered and reconciled if possible t I am aware that the ruling of the Court d A ruled of Gods dwell in all who free upon what Is as LofftlOption law for some years after it tt finm exacted were rigid so so aa to be regarded by the advo 4eeof the law as to r the benefits which to re fruit from Its adoption by the i But the later rulings said court con forming aa they db to manifest by its framers decidedly ore favorable to and ifit held by the courts of the Jwye at the con QMf ia itIhold the law the order the county court toe bo at next terra of court alter the direr wy only and not Suppose r Instance that atthe first term the of petition an should be tiled by certain citizens claiming that the names of many of the persons signed to peti tion were forged to said petition and in order to a charge the County Judge should conclude as be ought to do that it be proper to continue case until the next term of his court ould it contended that if at the term he found the charge to be false he would not have the right to have the order entered 7 Many other reasons might be given for a con tinuance of the If the statute be mandatory such could not be had and the court would be so hampered that justice could not be done I am well satisfied that the is di rectory only 2nd I hold that the pn ceedlugs sot on foot by in Its inception is the nature of an exparte and is largely under their control prior to the taking of the vote At they had the right if object sought to be by them bad been by the court in making the first order to come in person or by their and have the order cor I hold that the proper construction of the petitions filed shows their Inten tion to be to have the vote taken the entire district as a whole and not by the precincts Upon the case I hold that the of the Loral Option I have been complied and that the has been legally adopt ed the Oloverport district The of the contestants to the an swer of contestees is overruled and the petition of contestants is dismissed with costs to which contestants except and pray an appeal to the Court of Appeals is I desire to add to this that the questions raised by the contestants this issue are purely technical and with out real merit The order of the County Court submitting the vote to the people lla clear and explicit The voters all understood at the time the vote Will taken the law if adopted would apply to the die trict and with this a ma jority of votes cast was in favor of the law No comnlaint is made that any unfair means used or acts done to deceive or intimidate voters or to prevent a fair expression of the will of the people who had the right to de termine this question In case all doubtful points in the mind of the court should be resolved In favor of the will of the IF j WOMANS TRIBUTE TO WASHINGTON h The SCOTCH LEGEND How the Thistle Came to be ScotI Inds National Flower Do you know why the thistle is the national flower in Scotland The story is a pretty one and characteristic of the Scotch It Is said that centuries ago the Danes were making an inoad Into Scotland They were advanceing caat iously at night But unfortunately they were barefooted They had got close tto the Scotch camp when one of the men at the head of their column stepped on ia thistle Did you ever put your foot squarely upon a real Scotch thistle If you have you will not besurpriied to hear that that man gave a scream of pain Hit scream awakened the Scotch They sprang up precalvlng their enemies fell upon them and defeated them And the brave little thistle was made the Scotch flower Uztrnordlnnrr Cnrvlngi Some very extraordinary carvings are to ho found at Thomboo on the Irawnddy where they are cut out of the face of a high cliff rising directly from the river bank and are of great size They consist of a tile cliff is a pagoda of great sanctity which Is visited every year by largo numbers of pilgrims Three Mailed Schooner It was on the great lakes that the three masted schooner first made tin of dead rushes or grass which floated down among tho ducks without caus- Ing tho least alarm After watching the effect of his pro liminary fleet for a short time the fox taking a good sized mouthful of grass in his jaws launched himself Into the water as quietly as possible having nothing but tho tips of his cars and nose above water In this way ho drifted down among tho ducks and caught a fine mallard Though this story seems extraordi nary It must bo remembered that tho fox manages to capture wild ducks wood pigeons bares antI numberless other animals suQIcIcnt to keep him self and family
