He said too my wifes hens are obliging and I find no ticks at shearÂ¬ ing time lor they nab every tick they see Sheep bite so close and they eat bo many things that cows dont relish as bitter weeds briars and shrubs and the young ferns that come up early in the spring They cant bear confinement either like cows and as they bite closer they can be turned out earlier and get on well by having good rations of com in addition to the grass which is thin and poor so early in the spring When I boarded in my early married life with a progressive farmer he was always anxious about his lambs would not al- Â¬ low them to be chilled and would often get up in the night to look after them One night he found one staggering after its mother he wrapped it in his coat mado a fire heated some milk he was a teetotaller so instead of brandy he gave it ginger in the milk We all watched the lamb petted it through April and it did us all finally great credit I think a flock of sheep is just like people in a are so deeply tmblttertd by the proceedings convention Music Hall of the Bat it is permissable to call attention to the significant contrast in the quality of tho political leadership exhibited by tho opposing candidates for Governor Gen Taylora candidacy was opposed by the influences that had long been recognized as controlling bis party yet he received the nomination at the hands of the convention by enthusiastic acclamation upon motion of both bin opponents with the approval of a united party and with Â¬ out having incured any charge of tnbecomeing conduct Senator Goobel on the other hand had been prominent as a Democratic leader for years possessed Influence aud wealth and yet went into the convention with an apparently hope Â¬ less minority following It is not necess- Â¬ ary to discuss tho means by which be captured tbo nomination despite his lack of votes but at what a coat of bitterness wsa it captured at what an exercise of groes arbltry power at what sacrifice of party confidence and honor The adroitness that consists in providing flimsy pretext upon which to base the unscrupulous use of force is certainly not the political adroitness that Ken Â¬ tnckians of either party have been proud to see honored And rewarded But the adroitness which consists in quietly or- Â¬ ganizing unifying and directing party forces without injustice or wrong to any aspirants and which molds political strength to conform to tbo wishes of a free majority is more than adroitness it is political conform to the wishes of a freo majority is more than r droit new it Is political promptness courtesy and openness State cases long hung up on the dockets were brought to trial and rapidly pushed to a close The story of Gen Taylors first appear- Â¬ ance in the Suprome Court of the United States is an anecdote that illum- Â¬ ines the mans nature and capacity It was in tho case of the commonwealth vs Douglass involving the famous Frank- Â¬ fort lottery franchise This case bad been fought over in tho Kentucky courts and beffoged with bowilderlng specious con- Â¬ tentions A decision in tbo court of ap- Â¬ peals against the lottery company had been carried to the United States Sup Â¬ reme Court under what is called the Dartmouth College decision on vested rights Before Gen faylor assum- Â¬ ed office Senator Goebel had been em- Â¬ ployed by Gov John Young Brown himself an able lawyer and excellent Govenor with the approval of tho Leg islature to assist in the prosecution of the lottery It may be interesting to note that Senator Goebel did not appear be- Â¬ fore the Supreme Court with tho Attor- Â¬ ney General and his connection with the case is marked only by the entry that he was on the brief of William S Taylor Those who are informed of the rigid decorum and rule that govern the proceedings of the Supreme Court will appreciate the circumstances attend- Â¬ ant upon the first appearance- - of an obscure lawyer to make oral argument there Even the details of personal attire and manner are under critical fire and often exert an influence in winning the attention of the bench Many Western and Southern attorneys have in Â¬ vaded tho- - court in careless dress to find themselves chilled by the surroundings and regarded with the indifference their Ex- - Secretary carelessness invited Carlisle who had long been consulting counsel of the lottery and who was Sec- Â¬ retary and who appeared with Major D W Sanders in the case left the Treasury Department and paid the Attorney Gen eral of Kentucky the courtesy of moving his admission to practice in the court When Gen Taylor was sworn in it was observed that this country lawyer had been careful to adapt himself to the theater of an action His dress did not mark him as differing in without pretense began the presentation in that conversa- Â¬ tional tone deyoid of rant and harangue indispensibly requisite to good address in the court Gen Taylors argument was scarcely longer than a quarter of an hour but it proved to be a quarter of an hour of in- Â¬ calculable value to tbo States interest and of very far reaching consequences in the application of the principles he laid down to other cases brought before that court Its effect on the fortunes of the lottery was of small interest but he suc- Â¬ ceeded in netting from the court the germ of a decision that was enlarged subscquentlv in the suits against the Covington and Newport water compan Â¬ ies and in the State bank cases into the rule that tbo reserved powers of the State were sufficient to alteramend or wholly repeal any charter or franchise granted by the legislature unless it was expressly stated in the grant that it was in perpetuity and not to be repealed Up to that time these reserved powers of the State had been ruled to apply on Â¬ ly to subjects coming within a narrower limit called police powers of the gov- Â¬ As a result of Gen Taylora ernment contention enlarging the rule the Su Â¬ preme court in the case of tho Connecti- Â¬ cut Mutual Life Insurance Company va Sprattoy appealed from Tennessee and decided recently ruled with respect to all corporations doing business under statutory laws ot a State that in all auch cases there can be no contract springing from a compliance with the terms of the act and no irrepealable law because they are what Is termed government subjects and hence within the category which permits the Legislature of a State to legislate upon those subjects from time to time aa tue publio interest may seem fit to require The daelaion was ot serious moment ho was an insatiable and devoted student fitted himself to be a teacher and before his majority was reached he had opened up a school and had made a local name for himself as an ambitious industrious youth of unusual ability While teaching others ho pursued his own studies ardently and thus obtained for himself a thorough English educa- Â¬ tion the value of which he has demon- Â¬ strated in the remarkable force and compression of his political speeches and legal arguments specimens of di- Â¬ rect virile Saxon power that have at traded the admiration and aroused the surprise of all tho distinguished public and professional speakers of Kentucky Young Taylor continued to teach and to study until 1882 but his stadiousness was not for the mere enjoyment of its processes He was charged with breath- Â¬ ing human ambitions and hopes Ho was no recluse or book worm All his studies were aids to his purpose which kept him in the midst of the public and political life of his county He was al- Â¬ ready known as a strong speaker and forcible debater and in 1882 he was nominated for County Clerk by the Republicans and administered defeat to a Democratic nominee for the first time in He mado the history of Butler county an efficient officer says one of his boy- Â¬ hood friends modestly read law during his term and at the conclusion thereof was admitted to the bar He was im- Â¬ mediately in 18SG made the Republican nominee for County Judge and for the first time in the history of the county a full Republican ticket for connty offices were put in the field a strict party fight was made and the Republicans were elected In 1888 he was chosen by his party as a delegate to the Republican National Convention which met at Chicago In 1890 he was renominated and re elected County Judge As such officer he made a fine record and was pressed to offer for a third term but de clined to do so During these last eight years of official life he practiced law and took high rank Louisville bar but finally realizing there was no alternative except to list or be mulcted with penalties the company did report to the Board of Val uation and was assessed for each year 1000000 beginning with 1893 on worth of property from which Bource nearly 33000 of taxes have been realized already and it will so continue to pay as long as its charter exists In 1892 the Legislature passed an act requiring the State Board of Valuation and Assessment to assess for taxation the franchises of the various railroads of the State Under the law it seems each railroad in the State made annually to the Auditor a report of all its property Auditor Norman and his associates on the board decided notwithstanding the law that the railroads were not liable for a franchise tax and hence none was assessed during their administration Shortly after Gen Taylors term of office commenced he discovered the fact and at once said to tho members of the pres- Â¬ ent board that the railroads were liable under the law for this franchise tax and that it was the duty of tbo board to Tho roads for make the assessment some time resisted and insisted that the rulings of tho old board on the subjct were correct The present board fol- Â¬ lowing the written opinion of Gen Tay- Â¬ lor finally made an assessment for each year since the present administration began As soon as the assessments had been made complete the railroads of the State yielded and without even offering resistance in the courts paid into the State Treasury franchise taxes aggrega Â¬ ting about 220000 Another important case successfully prosecuted was that instituted agalnet tho Frankfort Chair Company which finally resulted after the most stubborn litigation through all the court in a recovbry of and payment into the State Treasury of about 00000 The chair company was represented by Senator Lindsay Judge Pryor T L Edelen and W M Smith the Btate was represented ny General Taylor lone In this case tho Btate achieved an Important victory not only on ac- Â¬ count ot the large sum involved but be- Â¬ cause ot tho vital principals ot law to be determined as well In this case for the first time in the history of this State the Appellate Court held that debtors of the State could not plead in satisfaction of their indebtedness set offj this too not Â¬ withstanding the fact that thousands of dollars of indebtedness to the Btate bad heretofore been extinguished in various lltlatlona by such pleas Not before In tbe history ot the State had auy auit in volving so great an amount been prose anted in behalf of the State hy an AtÂ¬ torney General without OMtatant eoun Â¬ Â¬ St John Boyle the State finally succeed Â¬ ing in securing the payment into the treasury of over 70000 In 1817 a number of corporations in Tenneesee instituted suit in the United States District Court beforo Judge Clark seeking to enjoin tho collection of taxes on over 70 per cent of their valuation alleging as reasons therefor that other personal property and lands of that State had not been listed at more than 70 per cent of their cash value In this caso the corporations succeeded in pro Â¬ curing tho injunction and Tennessee wero exact parallels of thoso of the Ken- Â¬ tucky cases Gon Taylor won the cases for Kentucky and tho injunctions were dismissed H1b success was attributable to his thorough work in getting up proof as Io tho assessments in this State It he had pursued the course followed by the Attorney General of Tennessee Ken- Â¬ tucky would have doubtless lost tho suit and thousands of dollars worth of taxes In Tennessee the Attorney General re lied alone on the law of the case while in Kentucky Gen Taylor most thorough- Â¬ ly prepared his case and by great effort sustained his contention with an abun dance of proof It would be difficult to determine the exact amount of taxation recovered into the treasury of Kentucky and directly attributable to Taylors efforts It is safe to say however that it
