Having rrceived solicitations from every district in the county to make the race for County Judge I decided to do so I Announced myself on tho 8th day of February In less thnn ono week some men in HardlnBburg dovold of principle began to say I was an extreme temperance man and it would not do to nominate me for the wlisky men would not vote for me if nominated It was not long until I heard of my opponents pay Â¬ ing neither the whisky men nor Catho lics would vote for me Various stories wero gotten up the last days of tho can- Â¬ vas One was I had driven two Catho lic women from my house Another 1 had refused to rent a house to n Catholic family It was charged that I was an A P A Humors wero sent over tho county before the convention saying I did not want Catholics to vote for mo I Railway Company which was heard in the United States Court at Louisville Ky on Wednesday and Thursday last Judge Barr gave the jury peremptory instructions to find for the defendant a verdict was accordingly rendered Messrs Gardiner and Moxley were attorneys for Plaintiff Messrs James P Helm of Louisville aud David R Murray of Cloverport represented the defendant This was an inter sting case especially on account of the law questions involv- Â¬ ed The facts were as follows Allen Northerner and Thomas Farguar wero miners aud had been working in the coal mines at Falcon in Hancock county but had quit and intended to take the morning train gong to Hawesvllle and thence to Cannelton Ind their homes They had their clothing in coffee sacks and had their tools tied together in one bundle It had been raining that morn Â¬ ing and the platform at the station was wet and slippery as also were the car steps When the train arrived at the station Farguhar got on tho train leaving Northerner to put the clothes and tools on the baggage car Northerner and Wm Robson took the clothes and tools to the baggage car and they with the assistance of Lewis the station agent put the articles in tte baggage car Noitherner remarked to the baggage master Put these off at Hawesvllle Thero was evidence that Northerner then started back to get on train Some of the witnesses said he stopped and told at least one person good bye and shook hands with him other wit Â¬ nesses did uot see this At all events the train starfed aud he let one coach the divided coach for whites and negioes pass and attempted to catch and get on the front end of the reer coach and m It sod his footing and fell under the wheels and was so crushed that he died several hours aftsr Neither Farguhar or Northerner had tickets
