the race for County Judge I decided to do so I Announced myself on tho 8th day of February In less thnn ono week some men in HardlnBburg dovold of principle began to say I was an extreme temperance man and it would not do to nominate me for the wlisky men would not vote for me if nominated It was not long until I heard of my opponents pay ¬ ing neither the whisky men nor Catho lics would vote for me Various stories wero gotten up the last days of tho can- ¬ vas One was I had driven two Catho lic women from my house Another 1 had refused to rent a house to n Catholic family It was charged that I was an A P A Humors wero sent over tho county before the convention saying I did not want Catholics to vote for mo I de- ¬ nounce them as urfo lies gotten up for the sole purpose of defeating mo I never voted against any man on acI have voted for count of ids religion Catholics in conventions and primaries when they had protectant opponents I Ilmveolwajs been on the very best of terms with my Catholic neighbors They have been warm friends of mine in both of my races In regard to the temperenco question I made plain aud candid statements that ought to have satisfied any reasonable 1 said I was a temperanco man man but my private opinions sliould havo nothing to do witli my official nets if elected I said plainly I would follow the course of my predecessors and gratit license when an application was backed by law I make these statements now when it cannot bo said I am seeking votes to show how unfair and groundless tin 89 charges were As unfair as thoy were Mr Minor owes his nomination to them I did all I could to keep these questions out I did it not only for my good but for tho good of tho party I will assert hud all the candidates for tho various offices used their influence they could have kept them out I knew they would hurt the ticket regardless of who was ou It Thero were no charges mado against my character nor my Democracy and if it was charged that I was not competent to discharge the duties of the cflice I did not hear it My only sin seemed to be that I was a moral man and that that kind of a man had no right to a nominr tion Gentlemen I want to say there is two sides to these questions and the 1 mo cratic party can not afford to ignore either It lias becomo a common saying in this Ciinty that a man who tries to make an honorablo and upright canvas cannot get a nomination iu the party Them were men who aro considered good men whose names are on church regis tTs that took up the temperance qvs tiou and used it against mo Now if tho fact of my being a temperance man dis¬ qualifies me for holding rfllco and a portion of the party will not vote for inn if nominated whero is the consistency in asking my friends to vote for tho man who gets Ids nomination by taking the other side Charlie Lightfoot Baid Monday lie did not think these questiors were used against me in Cloverpnrt I know they were common street talk on the night of the 5th and the day following I will refer him to Frank Fraize and Flailge Carter I could make many more The first man to tell me of tho religious question was Dr Sam OBryan of Mooleyville who I think is an hon- ¬ I know orable christian gentleman ¬ ¬ ¬ ¬ ¬ ¬ ¬ ¬ when Fladgo Carter camo to me in Clo verportand told me I was being knlftd there on tho grounds that 1 was a temperance man and an A 1 A he told me what ho knew to be true It does seem to me thero ought to be a stop to these things Tiiero lias not been many races in this county for some time that thrsi things did not bob up The party cannot hope for success as long I am as these things mako nominations a Democrat I beliovu in the principle of the party which gives fo every man the very broadest religious liberty If the party desires success in the county there must be a radical change on thine lines Thero is a remedy and now is as good a timo to apply It as wo will eyer have In conclusion I want to thank my friends for their very earnest support I am glad no one dared to use these things in mj district There was ono other place they were not used that was Custer It wus through the iilluenco of Mr Cook they My voting place has wero not used brought mo under many obligations for their almost unanimous support No ¬ JOLLY STATION Horn to tho wlfo of Mr Horaco Bland the th inst a nine pound boy Mrs Nelson Jolly sajs we adhere to the principle upon Is thnt which the government was established nnd Insist upon their fiilthful observance Equality of rights must prevail and our laws be nlwnys nnd everywhere respected We may have failed In tho nnd obeyed discharge of our full duty ns citizens of this great republic but It Is consoling nnd encouraging to realize thnt free speech n free press free thought free the penalties of the law The preservation of public order the right of discussion the Integilty of courts nnd the orderly administration of Justice must continue forever the rock of safety upon which our government securely rests One of the lessons taught by the late election which nil can rejoice In Is thnt the citizens of the United States are both law respecting nnd law abiding people not easily swerved from the path of patriotism nnd honor This Is In entire accord with the genius of our Institutions nnd but em phasizes tho advantages of Inculcating even a grenter love for law and Admlrstrator of Allen Northern ¬ er against tho Louisville Henderson A St Louis Railway Company which was heard in the United States Court at Louisville Ky on Wednesday and Thursday last Judge Barr gave the jury peremptory instructions to find for the defendant a verdict was accordingly rendered Messrs Gardiner and Moxley were attorneys for Plaintiff Messrs James P Helm of Louisville aud David R Murray of Cloverport represented the defendant This was an inter sting case especially on account of the law questions involv- ¬ ed The facts were as follows Allen Northerner and Thomas Farguar wero miners aud had been working in the coal mines at Falcon in Hancock county but had quit and intended to take the morning train gong to Hawesvllle and thence to Cannelton Ind their homes They had their clothing in coffee sacks and had their tools tied together in one bundle It had been raining that morn ¬ ing and the platform at the station was wet and slippery as also were the car steps When the train arrived at the station Farguhar got on tho train leaving Northerner to put the clothes and tools on the baggage car Northerner and Wm Robson took the clothes and tools to the baggage car and they with the assistance of Lewis the station agent put the articles in tte baggage car Noitherner remarked to the baggage master Put these off at Hawesvllle Thero was evidence that Northerner then started back to get on train Some of the witnesses said he stopped and told at least one person good bye and shook hands with him other wit ¬ nesses did uot see this At all events the train starfed aud he let one coach the divided coach for whites and negioes pass and attempted to catch and get on the front end of the reer coach and m It sod his footing and fell under the wheels and was so crushed that he died several hours aftsr Neither Farguhar or Northerner had tickets The law questions involved wore First Was the relation of carrier and passenger established It appeared that the baggage master was also Express agent and yery frequently articles were put in the car uuder similar circum stances and he would go back through the can and fiud it there was a passenger to represent the baggagb if none lie then billed it as express matter Judge Barr held that there was enough evldecce on this point to justify submitting the question to the jury Second Did the train remain at the station a reasonable length of time to allow the discharging and taking on of passengers The judge also ruled that this was a question that might be decid ed by the jury Third Was Northerner guilty of contributory negligence resulting in his death by attempting to get on a moving On this point beheld that the train evidence for the Plaintiff showed that Northerner attempted to get on a mov ¬ ing train which was moving at au In ¬ creasing speed and when he made the attempt the tialn was moving about four miles an hourand from a patform which was admitted to be wet and slippery and thattneu was such contributory negli geBee as to prevent a recovery and heuce he instructed the jury to find for the Defendant The aeeideBt occurred on Mareh 7 1805 The Plaintiff sued for 16000 damages The
