William Yost of tho Superior Court who was passing through jlfeqilyfhen asked If a member of tho General Assembly is eligible to havo theollictpfjAljutant General bo said Unquestionably he is Thero is no inhibition in the Constitution against it On the other hand thero is an express provision which makes him eligible In section 1G5 oi tho Constitution it is provided that up person shall at tho same time bo a member of the General Assembly and an olilcer of any county city town or other municlpalltyaud no person shall at the same time fill two municipal ofllces either ini tho same or Ib will be ob Â¬ different municipalities served that tho Constitution simply provided that no person shall while a member of tho Genoral Assembly bo aa ofllcer of a different class viz an officer of u county city town or other munici- Â¬ pality As the Adjutant General is not an ofllcer of the latterclasa it is obvious that there is no Inhibition in the Con- Â¬ stitution against his being that o dicer and being n member of the General As sembly Aido from this however tho latter clauso of tho section abovo referred to expressly provides that an officer of the militia shall not bo ineligible to hold any other office mentioned in tho sec- Â¬ An officer tion The law Is as follows of tho militia shall not be ineligible to hold uny other ollico mentioned in this section The only question remaining is Is the Adjutant Genoral an officer of the militia It is absurd to question this He is recognized as an officer pf the militia in the Constitution and in tho acta of the General Assembly concerning the militia o the Commonwealth passed in the sessions of 1S91-2-Section 222 of the Constitution pro- Â¬ vides that all militia officers whose ap-Â¬ pointment is not therein provided for shall be elected for such terms as the General Assembly may direct It is however therein expressly pro-Â¬ vided that the Governor shall appoint an Adjutant General and his other staff officers It will of course be conceded that this section makes the Adjutant General a militia officer Now let us tako theijact herein re- Â¬ ferred to i e An act concerning the Tho Militia of the Commonwealth eighth section in fixing the staff- of the Governor provides that it shall consist of twelve oiucers ana urst ot tneso is An Adjutant General with the rank of Bri- Â¬ gadier General Section 20 provides that officers of the militia on the military staff of tho Governor Bhall be appointed for a term of four years and all other officers shall be elected for a term of three years Section 20 provides that commissioned officers of tha militia shall be command Â¬ ed by the Governor and every ofllcer ex- Â¬ cept thoso on tho staff of the Govornor shall be examined touching their quali Â¬ fications Section 54 fixes the pay of all of the militia beginning with tho Adjutant General and ending with tho lost private in ranks of the State Guard INow as there is first no inhibition in tho Constitution about ono person holding the two offices of member of tbe General Assembly and Adjutant General second as there is an express provision in that instrument that one person may havo thoso two positions third as the Adjutant General Is recog- Â¬ nized and allowed both in the Constitu- Â¬ tion and the acts of tho General Assem Â¬ bly as an officer of the militia I am clearly of tho opinion that there can bo no
