interviewed at Frankfort upon tho subject of assuming the office of Ad jutant General without resigning as a State Senator from tho Tenth District Gon A J Gros3 said Section 105 of tho Constitution reads as follows No person shall at the same time be a State officer or a deputy officer or member of the General Assembly and an officer of any county city town or other municipality or an employe there- Â¬ of and no person shall at tho same time fill two municipal offices either in the game or different municipalities except as may be otherwise provided in this Constitution but a Notary Public or an officer of the militia shall not bo ineligi- Â¬ ble to bold any other ollico mentioned in this section This is the supremo law of tho State and when its f ram ore provided that the holding of gave mo the appointment warranted you in doing At tho Bame time requested mo to hove an interview with the reporter or officials of Tho Lou Â¬ isville Times or as you afterward sug Â¬ gested to write out u statement and give it to Tho Times stating tho circum- Â¬ stances under which I assumed the duties of chief of your statr This I agreed to do but as this conversation occurred on the 30th of April I did not immediately attend to your request waiting as I thought right and proper to turn over to Senator Gross the keys and office with which I had been intrusted Senator Gross arrived in Frankfort on the morn- Â¬ ing of Tuesday May 1 and after turning over to him tho keys and ollico of Adju tant General I returned to Louisville the same day This I thought necessary and becoming I must
