SENTIMENT AROUStw BY EFFORTS OF INFIDELS Editor of Blue Grass Blade and Oth thers Attempt to Make It Appear Newton Man Is a Rellg luos Martyr Special the Capital Newton Iowa August 13Sentt ment here has teen aroused within the past few weeks for fear that Governor Cummins may pardon or parole Dr Marian R Hammer sent up from here some months ago for an assault with attempt to commit murder upon the person of Oscar Heathcote The case Is well known it having attract ed attention throughout the state at the time Tne movement for the re lease of Dr Hammer from Fort Mad ison penitentiary has been started by Charles Moore editor of the Blue Orass Blade the official organ of Infi delity In this country published at Lexington Ky Moore It has been learned from reliable sources has taken up the case with mo governor and Is pushing it with all his might His motive so far as can ho ascertained is that of ono believer In infidelity to another for Dr Hammer was a personal friend of Mr Moore and at one time one of the circulators of the Blue Grass Blade In this part of the country Once when Mr Moore two years ago appeared in this city to make a speech he was entertained at the home of Dr Hammer and the friend ship df the two men formed then has never been broken Mr Moore has aroused much Inter est In the case of Dr Hammer throughout by publishing In his paper a story which places Dr Hammer in too light of a martyred hero held under custody In the Iowa penitentiary as the result of persecutions arising because he is a nonbeliever So much Interest has been aroused in favor of Dr Hammer that It has been learned here that scores of names are being sent In to the governor dally attacheu to blanks which Mr Aoore Inserts In his paper with every Issue Along with this knowledge it has been learne that the names sent in to the governors office have with but nine exceptions been those of parties living entirely outside of the State of lostn They are signed by citizens w York St te Florida Mlnneso Un Pjcky One of the persons Iner ested In the case is a man named Jos hua T Small residing at Province town Mass where he runs a small bakery and poses as a representative of the school of natural healers His letter to the governor It is learned was accompanied by a lanatlcal cir tjcular designed to cast reflection on practice of medicine Mr Moore of the Blue Grass Blade claims wonderful things for himself He admits that he has been In the penitentiary once In the state of Ohio but claims ho was here through persecution similar to that of Dr Ham mer and that he was pardoned by President McKimey before he haw serve one year of ins term of live years Ho claims hat he Is the grand son of Barton W Stone one of the founders of the religion what is known as the Church of Christ and that he was ordained to preach for that de- nominatIOn by Alexander Campbell During his ministry he claims he converted an Ins tlei to his faith and baptized him and then in turn was converted by the Infidel He Is a staunch admirer of Mary Mac Lane the Montana girl who has recently come before the public as a writer of her inmost thoughts and feelings Mr Moore in his paper recently takes the stand that In Mary Mac Lane he has found his Ideal woman that she stands for all that Is the highest and best in womankind Mr Moore did not create a very pleasing impression In this city when he was here two years ago and the people generally are very much disturbed now for fear he may be instrumental in bringing about the pardon of Dr hammer Henry Sllwood the county attorney there is making a strong effort against the pardon and hopes to make such a showing to the governor as to preclude any possibility of Ham mers release Dr Hammer It will be remembered made the assault of which he was convicted after Oscar Heathcote his victim had appeared before the grand Jury here against the defendants son They met the street September 22 1900 andI after some words Dr Hammer drew a knife and assaulted Heathcote who was not so badly wounded but that he recovered Dr Hammer was de fended by E J Salmon of this city and McHenry McHenry of Des case was tried In Poweshlek county before Judge Bishop It was appealed by the defendant on the ground that the judge left the room Willie the trial was proceeding The state argued that It had been agreed that Judge Bishop should retire and prepare his instructions and that he did nothing out of the way in leaving the court room during the trial The supreme court upheld this contention of the state and Dr Hammer was sent to Fort Madison last April after his case had been decided by the higher court- teolJe here are of the opinion that Dr Hammers sentence of three and onehalf years was comparatively light one and they do not favor his release at this time There is another r indictment It is said ready for him if he is released It Is alleged that t lu recent ears he drew a revolver on several prominent men here threatened to stab others and that ho once spit In the face of a prominent man besides calling several leading citizens the vilest names These things have conspired to create the sentiment against Dr Hammer Among the mon who are said to have been threatened and abused by DrI Hammer are Drs C C Smeatf Perry Engle B M Fallor and exKsnator Gorrell It Is also charged by persons hereI that the letter which appeared In theI Blue Grass Blade In behalf of Dr Hammer some months ago was writ ten by Dr Hammer himself and not by the editor of the paper Although it Is not known what the governors decision in the case will be the ef forts to avert the pardon will bo con tinned It is possible that a petition from the leading citizens here protesting against such action will be sent to the chief executive In the near future- Inquiry at the governors office hasI confirmed the facts stated above as to the case of Dr Hammer being tak en up by the editor of the Blue Grass Blade The statement that all of the persons seeking the pardon are living outside the state except nine is also confirmed The governors pardon sec retary states that no action has been taken in the case and until such is done he does
