ine havoc with the dynamiter and the JournalNews of this city feels F called upon to say a word in the way of criticism of this sort of evi dence The JournalNews is afraid that this silent little witness will be permitted to testify against its now I xtfoundifrleride the dynumltersI The JournalNews says llThe dictagraph therefore opens an entirely new field of evidence that may or may not under a thor l ough canvassing by lawyers and the courts be admitted into trial re cords Every consideration will be devoted henceforth as heretofore to the basis principal of Jurispru dence ln this country that a defendant z isjpresumed Innocent until be li proved guilty What weight therefore to attach to telephonic records o of conversations and how generally to admit them as convicting evidence is the problem that r confronts lawyers In the orimnal i practice and judges of the orimnal i and reviewing courts Such a problem will arise and an effort will be made to get a final ruling In tbe trial of the alleged dynamiters at Indianapolis The assumption that a diotagraphio record is prejudicial to a defendant may be based on thej 1 fact that the transcriber of the notes may be In error or nay bo wilfully changing conversations to suit the instanceI4 cuesInotes on which two convictions were obtained as an illustration of the dubious side of the dlotaKrapbI So the JournalNewi has found one instance where a stenographer practiced fraud on the court andI forged shorthands notes etc and therefore it would be possible for hIstenographers who took down the conversations of dyiiamlter Ryan and btslooconspirators through theI H dictagraph might make false notes and doRyan and his brother crim- nalsaninjusticeasthey would be deprived of the benefit of a reason able doubt The JournalNews j needntbelalarmed about Byan andi r his friends They will be on hand at the trial to swear the little dicta j graph and the stenographer out of existence We would suggest that l the most practical way for the JournalNews to help its criminal union friends Would he to send a member or two of its staff up to Indianapolis when tho trial Is called and get them on the jury The editor of the JournalNews by the way is a great lawyer He says the assumption that a dicta graph record Is prejudicial to a do fondant may be based on the fact that a transcriber of notes may bet In error or may wilfully Change notes etc etc We would sug Best to the lawyer of the Journal News staff that the courts will not assume that a fact exists and the defence hi this case when it comes up will have to prove that the stenographers wore In error or thjt assume or presume that the stenographers actedscorruptly notwithstanding tho in fluenced opinion of the lawyer on the JournalNews staff For th benefit of the Journal NeWs if i desires to get on the right track we will stat that the little dicta graph is used principally for the purpose of securing evidence for the detectives and the prosecution to act on and to confirm and corroborate thd evidence already secured by the State and the silent little de tective the dictagraph will not be allowed to testify In open court un less it is first shown that It was Ry ans and his confederates voices that were recorded by the little machine If for Instance the stenographers chance to be familiar with the voices of the conspirators and can testify that they are the men who were talking in the room and whose words were recordedthen the little silent witness the dicta graph might be allowed to testify To The Public I am in the
