alleviate suffering and succeeded Unsafe Insurance Speaking with a Kentucky fire insurance man the other day an in teresting incident was brought out which illustrates the condition of affairs that will obtain in Kentucky if the respectable insurance companies now doing business in the State are driven out by the exces sive fines certain prosecuting attorneys are preparing to have assessed against these companies upon the charge of forming a trust Already in some counties of Kentucky a number of the best fire insurance companies have ceased business because of the fines imposed in the lower court A test case is in the Court of Appeals and a decision is expected in April The question of the safety of insurance secured through foreign brokers in companies not allowed topo business in Ken tucky under our laws enacted for the protection ol the assured will be an interesting one to property owners if indeed the companies now doing business in the State are forced to withdraw or to in crease rates gr self protection The incident is to the point This gentleman was a few years ago in charge of an agency in a southern city There was a large tack fac tory insured through the local agencies which was shut down with no immediate prospect of re suming operations The agents notified the owner of advance in rate because of the increasedrisk of carrying an idle factory The owner said he would not pay the rate and proceed d to buy the insurance he wanted through foreign brokers The factory burned and he did not collect over about fif teen per cent of the face of his policies The broker was irre sponsible and the location of two of the companies whose policies he had bought could not be found Their address was nowhere but on the worthless policies he had purchased to avoid paying an equitable rate fixed according to principles of the insurance busi ness as decided by the judgement of his own fellow townsmenIIt is a bad and attacks the interests of the business man and property owner as well as the insurance companies The farm ers as a class are not affected be cause the farmers of this section as class do not insure And a numI ber of fire insurance companies do not the attempt to fine all such companies under a law that imposes heavy penalties which would tax them so severely as to drive from the State is attracting widespread attention and comment A number of insurance Uanles it has found expression in In dictments and in Ibe trials in Franklin and Scott where penalties have been 1mI poed oa the cqmpaaiefl tot what they con siderlo have been a service rendered to Ibe people- A great many people do not understand that all the fire insurance expendiinreas in every other business must be borne by the Income that if the expenses and fire losses lire paid from the capital no capital will ong stand as a guaranty of safety The premium alone must pay all such outgo Its not right where extraordinary expenses are levied by action of the people to charge hat expense to people who have not par- icipated in imposing penalties In the county of Scott at Georgetown where the income is about 20000 per aDI Dam a jury during the present weeknnder the advice of the Court and Common wealths Attorney levied penalties amount to 24000 against the fire insurance protecting property in that com munity It is necessary therefore that the people who impose these penalties hall be made to pay for them and I re spectfully recommend an increase of 100i per cent in rates upon all risks in Scott county In Franklin county the penalties imposed amount to a very large per cent of the income of that county and the city f Frankfort and I respectfully recom m ni that the rates current in Frankfort nd Franklin county be increased 50 per ent those increases
