Judge M C GIV- ens of Henderson that able jurist and well known Democrat and was published first by the Hender son Journal which paper Only v hopes that his views on the cpu stitutionahtyof the law are erron teous TUE BEE takes pleasure in reproducing judge Givens review cf the Election Law and recom lt I mends it to the careful perusal of the voters of Kentucky It is in fullas follows The concern of the people of Kentucky about this Goebel election bill should be no less than about the Constitution of the State Itself However much men may differ as to the intrinsic merits of thIs bill all must agree that if It conflicts with ibe constitution It should be annulled by the cowls as soon as may be To show that it does conflict with the Constitution of the State Is the obect of this short article In the outset I shall assume that the ueneral Assembly has no power to create or flit an office except as it derives that power or authority from the Constitution of the Stale Section i of the Goebel Dill is as follows The General Assembly shall at its present session elect tbieo commissioners who shall be styled the Stale Board of Election Commiissioners They shall bold office for a term of four years and till their successors are elected and qualified a It If a vacancy or va cancies occur white the General Assembly- Is in vacation the same shall be filled by the remaining member or members of the boardThree distinct and vital constitutional questions necessarily grow out of this bill and the election held under its provisions The first question is Can the Legislature create these State offices Assuming that It may create them the second question is Can that body also fill those offices by an election And assuming that the Legisla ture may both create these offices and fill them by an election the third question Is Has there In fact been a valid election un der the Constitution and this act of the General Assembly First Has the Legislature the coast tutional power to create these Stale offices After creating all the State offices desired- or Intended and all district and county offices intended to be permanent Section 107 of the State Constitution makes this provision The General Assembly may provide for the election or appointment for a term not exceeding four years of such other county and district ministerial and executive officers as may from time to time be necessary This section of the Constitution distinctly limits the power of the General As sembly and confines it to creating county and district offices of a special kind To argue in favor of the constitutionality of the Goebel bill one has to assume that the General Assembly is under no constitutional restraint as to the creation of new State offices This proposition I am persuaded noone will willingly assume and need not here be further noticed Comment can add nothing to the plain meaning of this section of the Constitution It speaks for itself and needs no Interpre tation If Its meaning is not plainly man ifest it would be useless to try to find out its meaning by any species of argument But assuming that the General Assembly may create State and other offices It does not necessarily follow that it may also fill the offices thus created by election or appointment Section 107 of the Constitution says the General Assembly provide for the election or appointment of county and district officersVProvide bow Not by a special law certainly for that is expressly forbidden by sub section aa of section 50 of the Con stitution Again section 148 of the Constitution provides that all state district and county officers shall be elected on the first Tuesday after the first Monday in November The Legislature can not be- n session on that day so it could not have been contemplated by the framers of the constitution that any Stale District or County officers should in any event be elected by the Legislature- To provide for the election to fill newly created offices can only mean to provide for their election by the people at the regular elections as provided in the Consiilu lion A special election of or for a State officer can not be provided for by the General Assembly other than on the reiju lar election day The first Tuesday after the first Monday in November except in a case of a vaancy in one or the other bouse of the General Assembly as is specially provided for in tbe Constitution The time at which State and other officers are required to bo elected and the further fact that the Legislature cannot enact a special law on tbe subject of elections or fix any other day precludes absolutely the idea of Ibat body having been entrusted with tbe duty or power of electing State or other officers in any event whatever If we will consider the limited lime the General Assembly is allowed to sit with its many ctber Important and imperative duties to perform the same conclusion is reached that the election of State county or district officers is no part of Its powers nor duties Again looking at many positive restric tions placed upon the General Assembly by tbe Constitution shows clearly that tbe people aimed to restrict rather than en large its powers in that direction It will not allow that body to meet oftener than once in two years and then not to remain together longer than sixty days under any pretense whatever Its powers to enact laws was greatly abridged It was limited in its election of pages and janitors Its power to elect a United States Senator would certainly havs been taken away if it had been within tbe power of tbe people to have done so Can it be that while tbe people of Ken tucky were not willing to give the General Assembly discretionary power In the elec tion of its pages and janitors for a period of sixty days with powers only to carry bundles and sweep halls they supposed that they were by implication confering on the same General Assembly unlimited power to create this great army of 360 officers with unlimited powers over the election of tbe State and all beyond the reach of the people Such a suggestion is a libel on the good sense of the people of Kentucky Third But assuming that the General Assembly may create and fill these offices by election has it In fact done to as pro vided in the act itself This act says these election commission ers shall be elected by the present General Assembly Now what Is tbe General As sembly What does It take to constitute a General Assembly There can certainly be no division of opinion on this question The Constitution creates and defines tue lakes effect approved by him or being disapproved passed as a bill is passed over bis objec lions It The General Assembly did not elect nor j did it attempt to elect these Commission era by order vote or resolution The General Assembly did attempt to do o by resolving itself into a joint Assembly anda voting for them as a Joint and cot as a General Assembly Now whence comes this Joint Assembly and what are its powers and duties lJy virtue of wbat- provision J of the Constitution does It exist It looks as if those having tbis matter in charge seeing that if the election was bad t by the General Assembly the governor might not approve it in which event therep was not time to pass the vote over jeclions It was therefore resolved that the General Assembly should be transformed into a Joint Assembly for the purpose of evading this plain provision of thea Constitution as well as the provisions of the act under and by virtue of which the election was held So the Goebel Bill Itself is not only in plain violation of the Constitution but the election as held was in violation of the plain provisions of tbe Constitution and of the bill itself The election was not held by tbe General Assembly But it It be that a Joint Assembly and the General AssemI bly be the same then under the provision of Section 89 of tbe Constitution the vote of the Joint Assembly should have been presented business situation might well be expressed by the single word crops It Certainly the very flattering outlook reported in nearly all the graingrowing sections ot the country and particu larly as regards the growing wheat has been of a nature to dominate the entire trade situation From all of the surplus wheatgrowing states there comes but one report that of a large acreage extremely good weather and crop conditions already foreshadowing an unpre cedented production of the king of cereals With the steady and favorable progress making toward a large wheat yield has come the final culmination of the May wheat deal and a considerable quieting down of speculative fever and prices The close of the week witnesses an immense shrinkage in the price paid for cash wheat as compared with a short time ago partly the result of course of former high prices inducing a freer movement of reserve wheat stocks into sight not only at home but abroad That the ultimate et fect of the
