is iu accord ance with it We hav no right to go beyond the teachings of the scriptures and therefore do not believe in Ills au thority of thv decrees of Pope council and conventions save as they are en dorsed by the Bible Of course we must not let our church government lead us into things contrary to the will of God or interfere with our duty to our- elbwmen and we claim that it does lot do this but emphasizes love to God aud our fellowmen ant does uway with tuu fear of mull As Baptists we tel that our church government is sup ported by the word of God even those passages given in our subject And we foul proud of it not because it gives us the right to be narrow bigoted and intolerant but humble patient gener ous Mud loving Then under it let us march to victory keeping ever before us One establish their right to vote in the ted oral courts Jackson W Giles has now gone twice to t e Urited State Supreme Court for relief from the discrimina tion practiced against him by the Ala bama authorities and each time has been thrown out of court on a techni j mem1bereBrewer and Brown took his aide and Justice L re wer pretty sharply riddled thearguuieut by which Justice Holmes iu the majority opinion broadened the scope of the case beyond the record of appeal on the question of the Circuit Courts jurisdiction and proceeded to to declare that aa Giles at tacked the validity of the new Alabama couatiluiou he could have no standing aa a petitioner for registration claiming that be was qualified uu der it Justice Brewer held that no question but that of jurisdiction was before tue court that the lower court clearly had jurisdiction and that- t e refusal of the circuit judge to take it should have beeu reversed In the later case just decided Giles gets less comfort Justice Harlan alone dissents from the prevailing opinion written by Justice Day The case is again dismissed this time for want of jjurisdiction Giles brought action In the state curts but was de feated Ue then appealed on the ground that his right under the Con stitution of the United Stales were denied It seems however that in the state courts he did not base his claim to registration on those rights but en on Lila rights under the state laws Hence no Federal question was raised on which the Uuited States courts could review the action of the state tribunals for all that appeared regis try was deuied for reasons other thau any which would have infringed his riguiH under the Federal Constitution This omission was fatal to the appeal JN either of these cases secured a decision the nitrite of the question of Ne gro rights and the valid ty of the Southern State constitutions avowedly Intended to disfraushise Negroes It is to be hoped that before sung some body with the requisite legal skill wilt get the matter squarely before the Su prewe Court and lorco a decision uu the validity of me disfranchising clause of these constitution Tue ojurt will wake void any such decision as long as it eau but bur that it is uot to be blamed No wise court ever goes out ol its way to decide a question es pecially a controverted p Attica ques tion anti the result of one conspicuous attempt of the United States supreme Court to do It in the Urei Scott use ia a warning which will not be forgotten The court has uo business with a case which does nut come before it properly Neither can It be expected to teach lawyers how to prepare their canes or to wake allowance fur mistakes We are not yet prtpareu to believe that the Supreme Court itS helpless to enforce the bupreuie law of the laud and protect citizens of the United States from invasion of their rights by the States or that the judges iu a spirit of acquiescence iu conditions that cannot ue conveniently changed are prepared to abdicate their fuuc tious aa expounders the Constitution as it ex BIB However souud may be the argument of expediency with ref ereuce to new political notion on this difficult question the duty of the court is plait and the rights of a Negro when his ease is properly presented should be upheld as vigorously as they would have been iu 1871 when nation al sentiment was strong in favor of the most vigorous enforcement of the new constitutional amendments If they really want to establish their right to vote that disfranchised blacks should proceed to lay the Touudatiojs tor their suits under meet the same fate are not surprises to those who have followed the trend of the decisions I of that body upon questions involv ing the rights of citizenship of Ne groes There is some hope howeve- in the fact that the Alabama case was dismissed upon a technicality and not upon its merits and that when a case gets properly belore the court in such a way as to make evasions impossible the right kind of a decision must come unless the general government is willing toI admit that it is unable to protectt the rights of its citizens in the sev I eral states It also encourages the I belief that the remedy for the dis- franchisementj o f Negroes in the South must be found in legislation by Congress instead oi through the courts but be that as it may tha- II question some day or other will b settled as it should be and as iitI must be- THE case of Jackson Giles in volving the suffrage clause of the new constitution of Alabama was dismissed by the United States Supreme Court for want off jurisdic t tion This does not finally dispose of the question for this is only on of a series of cases involving th constitutionality of the Alabama suffrage laws brought about the same time so as to avoid unneces sary delay in bringing other suits iif the first one was decidedadversely But this decision indicates the trend of reasoning followed by the court and again shows that Assoc ate I Justice Harlan is the only Justic- on the bench that may be depend ed upon under circumstances to sustain the contention that th- rr Constitution of the United States guarantees equal rights to every I citizen and exclusive privileges to none WHILE Gov Vardaman of Miss issippi may be opposed to the edu cation of the Negro and is willing to have him grow up in ignorance and vice he seems to be unwilling to have him lynched and burned by mobs in that State and for tha t endorsement of legal trial and legalI punishment he should be given due credit Last Sunday he went to Dadesville in that State in personI to prevent the lynching of a Negro prisoner and did have him remov ed to a place of safety to await trial under at least the fOl ms of the law He declared that he was opposed I to mob voilecce and pledged him self to insist upon prompt trials andI legal punishment of prisoners dur ing his term of office If this was done in every state lynching would cease and the law would be preaching and working miracles in Capernaum and ftf ulrages1 of Galilee Herod may have heard of Jesus before but this is the prst time his attention was aroused The common people for a year had been hearing him gladly now for thefirst time the news off his wonderful works reaches the price which ruled his country Herod the tetrarchSon off Herod the Great to whom his father had left the province of Galilee and Pelrea Tetrarch is a ruler of fourth and Herod s dominion are said to have been onefourth af the Roman province of Syria He had inherited all his fathers vileness of moral character without his strength courage and ability This is John the Baptist j he risen from the dead Conscience was not dead in this wicked man though it had no power to restrain him Like so many who defy the authority of God and refuse to believe his prophets Herod was superstitious Such men are always ready to believe the untrue Herod could believe John had risen from the dead but we never hear of believing in the resurrection of Jes us A bad man he had believed in a miracle but that belief did not Ir ad him to repentance For Herodias sake HisI brothers Philips wife Herodias was a grand daughter of Herod the Great and therefore both her hus bands were her half uncles This Philip was not the tetrarch but another son Herod to whom had Ileft none of his kingdom and who was living in obscurity in Rome Herod Antipas the tetrarch had been married to a daughter of Aretas the king of Arabia But on a visit to Rome he had met Herodias a beautiful ambitous uncrupulous woman Her husband Herodias was fiercely angry and urged Herod to put him to death He feared the multitude They were already alienated and the death of their prophet would make themI dangerous Even a despot cowers before a resolute people Herods birthdayThis feast was probably kept in the palace of Machaerus and John was in a dun Lioaruins of that palace two dungeons can yet be seen in one of which doutbless
